P.E parking ticket Scotland

Hi guys, another parking ticket thread.
Had a "fine" for £100 (reduced to £60), for 20 mins over stay in supermarket car park.
Wifes car so fine sent to her, mitigating circumstances....two kids flaffing around.
Whats the script with PE in Scotland? Some say pay some say naw.
Is it a/ bin it. b/ get the wife to reply saying she wasnt driving, or c/ write the supermarket.
I've told her to bin it, but dont want endless letters or court etc...

iN sCOTLAND THE rEGISTERED kEEPER LIABILITY POSSIBILITIES DONT APPLY SO SHE HAS JUST TO WRITE BACK TO SAY SHE WASNT DRIVING AT THE TIME,AND TO CONTACT THE DRIVER...BUT DONT SAY WHO IT IS. tHERE IS no OBLIGATION TO (oops damn caps lock) to tell them who is driving, no matter what they say!
Second poster is correct. No PoFA keeper liability north of the border. Only the driver can be pursued so the PPC needs that person's name.
A DVLA request can only give the RK details so that won't provide what the PPC needs. If you ignore the confetti it is in a hole.

In E&W there are plenty of cases where the PPC has refused to do so. It depends on the terms of the contract with the retailer.
The PPC may be under no obligation whatsoever to cancel its 'invoice' to the motorist.

problem with that is if supermarket rejects it, the supermarket ( and PARKING Co)have a name. What has worked for one local lady ( and this is in England) was for her to write to local paper. She's (in this case) ,spent some time in a queue at the in store cafe, then had a leisurely shop. Put shopping in to car and then looked in to other stores on the same site. Result 20 minutes over, as per ANPR. She wrote into local paper to make others aware and Asda local staff panicked and wrote back to go in and have ticket quashed. Obviously, you/wife write in in pen name with decent reason ( met old school chum and chatted for longer than expected etc),and I'll bet supermarket writes in to paper advising you to go in and let their friendly customer service staff kill this ticket. Great- take it in,but keep a copy of reply as evidence,so that supermarket advice is followed through. Hi,

Through my own research, I'm pretty sure it is actually illegal in Scotland for these 3rd party parking companies to be given your details by the DVLA.
Funny enough my "fine" says if it was not the named keeper of the car driving you must tell us who it is. FAQ off.
Their websites will say the have been successful in court etc but even if 20% of folk pay up they prob still make a load.

Complete crap of course, I called them on it & havent heard since.And in Scotland they can only sue for lost revenue which, if there was only one other empty space in the car park, would be NIL. So they won't take you to court as it would cost them loads to recover nothing!

OP - ignore it. You'll get 3 or 4 reminders at most, each one threatening all sorts of hysterical "court action" all of which is utter bks in Scotland.
Don't bother writing/appealing you're just wasting your time and they'll refuse the appeal and send you even more crap.
Let us know the name of the company and I can probably send you copies of letters from my collection.

Because the company is based in England, DVLA will simply assume the penalty charge is raised there.
