The buyer is claiming OP made misrepresentations. How is changing the oil evidence of that?

I've done it. It was a rental van and the shift gate was quite narrow. It's certainly possible. Moominator said:

I would say doing an oil change after a 'Ring trip is eminently sensible and nothing that would cause me any alarm. It's a long way to get there & back, and the oil will get abused on a couple of laps.I could see (some) grounds for the buyer to use that angle there.

Had a text this morning off the buyer stating the cars off to a garage on Tuesday and he'll update me what the outcome is. Haven't responded yet. Don't understand how someone can send that legal bks through email then send a polite text a few days after.

why you even in contact - its harassment.....
take advice and tell him to sling his hook. so if it comes back as something seriously wrong are you going to take it back ? give a full refund etc...
he knows what buying a car involves a private sale no comeback legally what so ever. nadda not a sausage not a bean nowt.
and you are still discussing it ? please for your own sake just tell him that his is the last conversation you are having with him. its his car. his problem and he needs to move on. accept that there is no comeback.
and if he continues then fire a warning shot off - its harassment. cheeky bugger....

And also (potentially) to convince a court that you're not, in fact, trading on the side - not a difficult allegation to make with short ownership and several car changes this year. Fail to convince them of that and caveat emptor is right out the window.OP, I'm not suggesting you are trading btw - but I'm sure you can see how easy it would be for him to allege that you are. If it does go near court, you need to be prepared to defend that angle to a judge who may not be familiar with the concept of enthusiasts getting bored with cars and swapping them frequently!

It's not harassment at all. The other guy has asserted that the OP has misrepresented the car. He's had a meeting, made his position known and sent an update on timing of the inspection. Hardly harassment.As one of our legal brethren has warned earlier on the OP would be unwise to cease dialogue.

Look, a misrepresentation is a statement of fact (e.g. I changed the oil after 3 months) that induces the buyer to buy and which is false. If, when made, the seller knew the statement to be false that's fraudulent misrep ( as opposed to a statement that was false but the seller did not know it to be false).Even if the oil was changed to 'mask a problem' I am not convinced telling the buyer you changed the oil is a misrep.
