driving down a road near me when someone in a fluorescent jacket runs out in the road waving his arms .turns out hes plod going in a house . no police car anywhere but i stop and he's very angry saying was i proud spinning my wheels !! i instantly defend myself and explain i wasn't speeding and I'm a bit old for that behaviour and the noise was the turbo as its a noble and does make a noise .he proceeded to get even angrier and did a check for insurance etc etc .eventually i drove off after still denying his accusation as i can put hand on heart i did not light the back wheels up and explained it was out of his sight and could have been anyone on the road at the time and asked him what proof he had .anyway transpires on friday get a letter offering driver alertness course saying I've replyed to a notice of intended prosecution or a ticket was issued at the roadside which i received neither its baffling me also there is no alleged offence either on the letter so don't know what I'm being charged for ! going to try to contact them in the week but its all very confusing and seems well over the top ! any advice would be appreciated

Usual score.

Agree and go on the course, nobody ever knows anything about it.
Or disagree and refuse the course. They may drop the charge, through lack of evidence, and it goes nowhere - or they may not, and you get to present your defence in court.

I wouldn't follow this advice. If they are offering him a course I'd bed good money they would run it to court. Then it's his word against a police officers. This is in the Magistrates courts. Where reasonable doubt, turns into balance of probabilities and then turns into whatever they fancy doing that day.

How long ago was the story? Is there anything in that letter which confirms it relates to the story? The eat wording of the letter will be important, might be best to respond to the letter explaining you've neither had a ticket at the road side or on the post so you believe that this has been sent in error.

I'm not aware of a specific offence - I guess you could only be done for not driving with due care and attention.
And how can the officer determine this just from the sound? "Expert Judgement??...."

P.S. I'm another knob, but have never been nobbled in my Noble. smile

Let's see if I understand this - you've been told you can go on a driver awareness course, because you chose this option after replying to an FPN you didn't receive?

This all seems most odd! You get an FPN, you fill it in, you choose the course or the points, and that's it.

Take a photo of the letter and post it up?

yes seems very odd .the letter came from the speed enforcement unit and i phoned them today .they said driving without undue care and attention and i explained it was the noise of the car , they said if i denied it they would send a form to fill out regarding mitigating circumstances and it would go to court . the letter i received is this .. please read the following letter carefully as it gives instructions on how to settle the above referenced alleged offence by booking and attending a driver alertness scheme workshop . we have received your reply to the notice of intended prosecution which we previously sent to you or ticket that was issued to you at the roadside in relation to the above referenced alleged offence . you asked to settle the matter by attending a driver alertness scheme workshop rather than taking the matter to court or accepting the fixed penalty offer of £100 fine and 3 penalty points endorsement to your driving licence . as stated before there is no offence on the letter and I've not sent anything back and didn't get a ticket at the roadside . apologies for the setting out of the above I'm not the best on these things

Spend half a day drinking tea and eating biscuits.

If you really are innocent and your first post is word for word true then go to court mate.
Should be able to pick apart the Police Officer's statement no problem if his judgement was based on sound and not what he saw.

1st things first though as posted above.
Reply saying you didn't receive any roadside FPN ticket nor a letter previously so this is a mistake.
