In the end it's a court if you and the retailer disagree, same as before. That said, there is a push towards Alternative Dispute Resolution - although the business is not obliged to use it in most situations. We'll have to see how it develops to change practices over time. I am not a lawyer though, I got my law information from Al Murray down my local pub.
