To be fair, depending who you got on the live chat/phone that day would depend what you were told. Literally every rep will tell you something different, very few will tell you something thats actually correct and in cases where a caller might be a bit 'antsy' shall we say they'll tell you exactly what you want to hear.
It's quite possibly the eBay bod said that to fob off the OP.

Maybe if your mechanic mate can declare the vehicle dangerous when supplied and the seller didn't tell you it was dangerous the seler has committed an offence. See Road Traffic Act section 75. Vehicles not to be sold in unroadworthy condition or altered so as to be unroadworthy.

This applies to private and trade sales.

how do you know when the seller bought it? might have been after the MOT, he might just have bought it, washed it for flipping.

We all know MX5s have rust issues, I suspect you should have done your inspection before handing over the money.

Can you prove the guy is a dealer? can you prove it was unroadworthy at the point of sale? if so maybe you could take him to court, if not, take the hit.

How much can you recoupe for soft top? alloys? engine? seats? body pannels? etc etc
