Why no PCN/Fines for driving in closed lanes on motorway?

On a slightly different subject, fog warning matrix signs are often not switched off until literally hours after it's all gone away, accompanied by 40mph limits (I'm thinking of the M5 especially), would you slow to 40 if you saw one of these when most other traffic is travelling at 70+? Or are these signs simply 'recommendations'?

As has been pointed out subsequently the signs on the M5 are advisory only unless in a red circle, for example the ones on the nearby M42 are compulsory. However, you shouldn't need them to make a decision for you. Idiots driving at silly speeds have caused some horrendous motorway pile ups in fog, so use your own brain when it's advisory. When the speed is compulsory, still use your brain to decision if it's still too high. Oh no, use of a brain is optional when driving is it not? Advisory, not compulsory.
My question was would you slow to 40 when conditions were clear but the signs had not been updated, as I was unclear if they were advisory or compulsory, so thanks for the clarification.
Obviously when it IS foggy and the signs have NOT yet been activated it doesn't mean "yay there's no 40 sign, let's pile on through at 90..."
