They are ATOL protected.

Hopefully the Op will have more luck initiating a charge-back with his bank, as I don't have any confidence in Action Fraud to do anything.

My rather naive nephew was ripped off on Gumtree whilst trying to buy an iPhone 6 - he reported it to Action Fraud and other than an automated response email heard nothing back, and nothing ever came of it... It appeared to be more a box-ticking exercise to get a crime-reference for insurance rather than anything useful.

I had a situation where there was fraud with multiple victims worldwide and Actionfraud were useless but the police got there in the end after badgering. It seems if you stole a fiver from a shop till you get done but a £400 phone fraud - forget it,
However I'm thinking if others in the UK have also reported then they will act.
