Hi All,

I need some help pls. I just found out whilst applying for a mortgage ... :-( i have a CCJ against my name £237 from Civil Court Enforcement Ltd , Horton House, Liverpool. I have never received anything in the post , no notifications in writing, no emails, no calls, nothing , I have no idea how this has come about, can anyone help? how do i get this CCJ overturned?

I am rather distressed.

Google their name. Looks as if they are a parking enforcement mob. Find out which court it is, and check the case number

Does this CCJ actually matter? I never know about these things.

You will need to contact the relevant court for a copy of the judgment, then work out what to do.

Have you moved house? They will (should) have sent court papers to the address of the Registered Keeper.

You can get a CCJ set aside if you can show they never sent the documentation to your address and did not give you reasonable opportunity to respond.

Are you the registered keeper of your own vehicle(s). Is the information held by DVLA up to date ? (i.e. does it show the correct address ? )

Mystic Aw51's crystal ball says that you received a parking ticket in a private car park 4 or 5 years ago - which you ignored as was the scipt before October 2012 wink - and you moved a couple of years later (after which any Royal Mail postal redirect service would have expired).

MSE has a similar forum as well, but the advice you will get is consistent on both.

Advice upthread that this can be appealed on the basis of "I received no paperwork" is correct - at a so-called "set aside" hearing costing you £150 or so - but people like CEL (as per the thread title) chancing their arm a few years later and winning by default if people (such as yourself) have moved in the meantime (and so don't receive anything from them) isn't unusual...

I had a tussle with a parking company last year- they didn't reply back in any form to my 'I'll vigorously defend in court etc'- they can't just apply for a ccj can they? They have to actually take you to court (you don't show as you didn't respond to the COURTS letter)

There's a clue in the name "CCJ" - County Court Judgement. A court has passed judgement on the claim.

Write to the court making an application to set aside.

Also ask the court for all documents!

All sounds a bit mental if you've had no dealings with the company yet apparently you end up with a CCJ?

I'm probably being naive but for a parking company to claim they've sent you paperwork and you end up with that against you means anyone could just go and claim you owe them money and if you're none the wise you end up with a CCJ?

Doesn't sound like you've had an opportunity to defend whether you actually owe them money or not. Again me being naive but do they just assume you decided not to show up in court?

An active outstanding i.e. unpaid (or resolved) CCJ has a major impact on your credit rating.

It will also have a negative effect on motor insurance too as insurers look for CCJ's as a risk factor.

You need to get it resolved and then contact Experian, Equifax and Callcredit to get a NOC (Notice of Correction) on your credit files.

That's right, most lenders will take this into account in a bad way, even if a small amount, ask your adviser to try Skipton if the ccj is ov two years old, they can be pretty helpful sometimes, although the most recent clients I had, they were defaults, for much more money, but repaid over two years ago. Most lenders have a tolerance level.

Feel sorry for the OP if he really did follow the Don't worry, you get away with bobbins that third parties were actively convincing people to do.
Because, they won't be offering to bail him out now, for actually taking their advice.

Fixed the name for you. They are a particularly disreputable bunch who regularly abuse the court process.

As another poster commented a favourite tactic is to dredge up a long dormant case based on an out-of-date address.
Doing this ensures an uncontested claim and consequent default judgement.

An unsatisfied CCJ will trash your credit rating and will scupper any application for a mortgage. You need to get this dealt with asap.

The reason is you have not received any Particulars of Claim so cannot tell what you are defending against.

My money says that it will turn out that you visited a Co-op supermarket car park.
