Hi all, my father recently passed away and I now have to sell his 2006 V50. It is in his name but he hasn't made a will. So my mum is applying for probate.

Now, can this be sold before probate or will it have to sit and wait? If probate takes a few weeks, that'll bring it to insurance renewal time and nearing MOT time in August. Plus I don't want it sat anyway.

I've had a look around google and can't get a definite answer. I'll even consider WBAC if I get nowhere with it but again I'm not sure how that will go with V5 in his name etc.

Any help appreciated

"If you are an executor as opposed to an administrator, you can sell the deceased’s car before applying for probate."

"If the deceased owned a car, the insurance will automatically become invalid and the insurance company must be informed immediately."

No idea if that's right/latest, but it sounds right, found here.

If nobody else is likely to claim it I'd get on with the sale. The new owners can complete the log book etc and you can sign where the owner should sign.

Thanks guys I appreciate that. Fortunately the insurance company just changed his policy to my name (with no fee) for the remainder of the policy. But it will then just expire.

I'll get on with selling it then, thanks again

I am sorry for your loss.

I was in a similar situation. My deceased father's insurance company issued a temporary cover note allowing the car to be on a road for a month, but not to be driven under the insurance. I could drive it under my insurance. They were very helpful and understanding. I put it in an auction, with full information as to why it was for sale. They too were helpful.

Two things not to worry about after phone calls.

I did this a couple of months ago. I just signed the V5 and put a note that it was on behalf of my Dad who had passed away. The DVLA sent the confirmation through as normal.

So it's either not a problem or they just didn't bother checking the signature smile

Never thought about auction, ill look into that too. I'll sign it and pop a note inside too.

Same happened to me but my Dad lived in Malta.

What a nightmare that was, the amount of hoops I had to jump through to sell it.....biggrin

I did this for my mother's car when she passed away. I was her executor and there was no problem selling it to a garage that was advertising for stock. At the time I really couldn't be bothered with trying to sell it privately.
