Posting on behalf of my brother who has requested it and has no account, how does this get progressed?

"In August 2014 I got a SP30 and paid the fine, took the 3 points, sent in my details and informed my insurance at the next renewal. I thought it was finished.

In March 2015 after coming back from working aboard for 2 months I found out that they have returned my money to me without my knowledge and destroyed my paper part driving licence. They have then summonsed me to a court when I am away.

On my return I write a letter saying this was 6 months ago, noticing that the money had been taken I complied once more and sent £100 again via cheque which was cashed and kept.

Without me present or knowing about anything a magistrate issues a 4 point penalty and £370 fine due to non compliance (I live in Kent this is in Gateshead).

Through to March 2016 many letters were sent between myself, Northumberland and North East fixed penalty office but do not resolve the impasse.

April 2016 - I send a letter to my MP who enables an investigation to the HMCT by the customer compliance team. At the same time I start having a bailiff come to my door (I refuse to acknowledge his legality as there is still a dispute ongoing in the matter).

July 2016 - The letter from the HMCT customer care team is a white wash (I need to get clarity here) and my MP sends the compliant to the HMCT ombudsman. The Bailiff continues to not come to my front door but to my car, harassing me.

This seems the most stupid of processes. They destroyed my paper part driving licence when I submitted it which started this issue. It's no longer needed. I've paid the fine twice, can they still continue this once I've paid? I'm going to get legal advice as continuously I have done everything practicable as well as possible to resolve this and it's getting frankly a bit of a joke - does anyone know anyone decent that can help me resolve this?"

I've sent him the link to monitor and I'll feed back replied (he can't reply on here himself even with an account owing to new poster rules).

Did your brother have both a photocard and a paper counterpart to the license, or was it one of the old school licenses from before photocards were issued?

Answering on his behalf it'll be the photo-card and counterpart (1992 birthday).

When he paid the fine, did he pay it within the timeframe set out on the FPN?
Did he also send both parts of his license away also?

If you could prove to the Courts that he was out of the country when the summons was received would it not be fairly easy to have the conviction set aside?
