Outcome should be you get a nice large fine.
I can only presume you haven't bothered to tax the vehicle and had no intention, had nowhere to store it and think the rules don't apply to you?
The reason why cheques became a thing of the past, is because of tricks like you did, stopping them, more fool the clamping contractor however.

No I had no idea it was declared SORN. Yes the taxing rules on a new van apply and all that but we were going to send the logbooks off when I was back from holiday.

Van stored and stripped.

I stopped the cheque as I had the raging hump they did not do as they said they would. The van was broken into while it was there as well. Luckily nothing in it.

I'm guessing I will get the DVLA fine but not so sure on the clamping contractor.

The OP seems to have some very bad luck (or form) when it comes to other untaxed / SORN vans he "owns" being clamped - unless it's the same one hehe

'Don't play the innocent with me, Barry'

You know you weren't going to send anything off. And come to mention it, when did sending the log book off have anything to do with taxing a car? Besides, there is a magical device called 'a computer' that you can look up websites that include DVLA 'tax a car online'.

Tough luck it was SORN'ed, if you followed the correct procedure, you wouldn't be in this predicament. So why did you ignore the rules then, go on, tell us....

I see the OP has now been deleted rolleyes To sum up for others:

OP buys cheap van, takes all paperwork including V5 but doesn't tax, SORN or send the paperwork off to the DVLA. Van left parked elsewhere (possibly at / near where it was bought). Van gets broken into, OP is made aware but waits until the next morning to deal with it where he finds it being clamped due to it being parked on the public highway whilst on SORN (declared by previous owner).

OP writes a cheque to cover the relevant fees but the clampers refuse to remove the clamp immediately as the cheque needs to clear. A few days later OP notices the clamp has been removed and decides to stick it to the clampers by cancelling the cheque and moving the van.

OP now wants to know what:

1 - the likelihood is of a fine / action coming from the DVLA for the issue of a SORN vehicle being stored on the road / failing to declare the purchase & either tax / SORN in his name.
2 - the clampers coming after him, once they realise he stiffed them with a cancelled cheque.

So a van I bought was parked on the road. I had been given the full log books and know the company well.

It turns out they had SORN the vehicle. It got clamped. I kicked off a massive fuss as I had just got there as the clamp went on.

I went down to the clamping yard which is run by a private company. I paid a cheque. I was desperate to get the clamp removed as someone had tried to steal said vehicle.

They said they would not remove the clamp for 10 days while the cheque cleared. They wouldn't accept a cheque without photo ID which I did not have at the time.

They eventually agreed they would accept the cheque, tow the vehicle to the yard and when I got back off holiday I'd come in, pay cash and get the van back and stop the cheque.

I got home van was still there, clamped. I got the hump and stopped the cheque. Two weeks went by and I heard nothing. It did me a favour as I didn't have a place to store the van.

One day I go to work and the clamp is gone. So I move the van.

6 weeks later and still heard nothing. The company did get a serious looking letter from the DVLA with a fine for a Sorn vehicle on the road. They wrote back saying it was sold to trade I.e me.

Nothing back 3 weeks on.

What do we think the likely outcome will be? The van is currently half stripped and will be scrapped.
Quoted for posterity. angel
