I have just bought a used Volvo XC60 from a specialist dealer. Having got the car home and driven it over the past week, we have realised that it is missing a feature that was definitely shown on the dealer's website listing. Whilst rain sensing wind screen wipers is a "nice to have" it is something that we wanted on the car, and are now disappointed that the feature is missing.

With modern cars having so many features, it's nearly impossible to check that every feature is in the car before purchase. Before I go back to the dealer I want to know where I stand if he plays "hard ball" and doesn't offer some sort of compensation.

What do you want to achieve?

As you've not suffered any loss I suspect you're on a hiding to nothing if you are thinking about "going legal" on the dealer.

If you'd genuinely not have bought the car if it didn't have that feature I suppose you could ask for your money back.

what he said I think. The dealer does not have to give you any compensation. He might, but he doesn't have to as he could reasonably argue the lack of that feature has no material affect on its value. If you can prove it is not as described (copy of the advert?) then you could ask for your money back. But is that what you want?
imho......

edit: by the way, have you experience of rain sensing wipers? In my experience (not of volvo) they are more hassle than they are worth........

Are you happy with the car otherwise? Is it really a problem?

I can genuinely say that when looking for a car that rain sensing wipers is on my must have list but i understand where you're coming from. I see rain, i put the wipers on; adjust speed to conditions.

You'll probably find this will be covered under their "errors and exceptions omitted" part of the small print.

we had the same years ago with a used Volvo. In particular it was meant to have bluetooth and it didn't. My mum bought the car and my dad went down to Poole or Portsmouth or somewhere very, very far south to get it (from northern Aberdeenshire!). Not knowing much about car specs my dad didn't notice it wasn't phone equipped. It had the microphone thing built into the driver's headrest but not the keypad on the dashboard. The ad definitely stated bluetooth but on following the missing option up later they said that it was a mistake as they got so many of this particular model in (no, it wasn't ex-police) and the car should have been rejected before driven away. It's a fair enough point but the reality is it's very difficult for a non-petrolhead to know what the car does and doesn't have and their faith is ultimately in the advert. To cut a long story short there wasn't much that could be done as the car was fine in every other regard and it would be far more hassle to give it back and find another one with all the other options on it and with the T5 engine so the issue wasn't taken further.

From my experience working in dealerships I'd say that if you really don't want this XC60 you can probably hand it back with enough arm twisting but by specialist dealer do you mean non-franchised?

Do you just want to moan, reject the car, have a free service, what? And is it reasonable? They aren't going to retrofit the auto wipers onto your car.

How have you determined the car doesn't have the rain sensing wipers?

When we bought our Volvo, I thought the wipers weren't working as I assumed they would come on automatically, but they don't the first time!

So, when it first rains, the driver has to switch wipers on, then select the setting for auto, and they will come on/off, change speed according to how wet the screen is. But if you go out on a dry day, and it starts to rain, the wipers don't start automatically. Essentially, you have to activate system first (with rain)

Try it with a hose.

The majority of XC60 windscreens that we fit are for vehicles with rain sensing wipers. Sales of the screens without this capability are very low. If you check the top centre of the windscreen from the outside, you should be able to see if this function is fitted to your car; there will be a sensor/lens attached from the inside with a silicone gel pad. Mail me a photograph of the area behind the mirror if you are unsure. Alternatively mail the VRN to me and I will check whether the car has the option.

Some cars default to intermittent wipe if there is a fault with the rain sensing function, so all may not be lost.

A couple of questions spring to mind:

1) Did you have to pay more for the car based on it supposedly having rain sensing wipers? - Or are XC60's the same price with or without rain sensing wipers?

2) Are you planning on rejecting the car due to not having rain sensing wipers? - Or are you planning on keeping it?


The reason for asking is:

1) If you didn't have to pay anything extra for a car with rain sensing wipers then you are not financially out of pocket.

2) If you not planning on rejecting the car due to the lack of rain sensing wipers, it can't be that much of an issue to you.

So assuming you didn't pay extra for the option, and the car is otherwise fit for purpose, what do you need compensating for? confused

I should imagine he needs to be compensated because he was lied to, and didn't get what he paid for, seems simple enough to me, I'm confused about your confusion.

The question is how much that compensation should be, not whether he is entitled to it or not.

Any update OP? Have you established that the car is definitely not fitted with this option rather than it being fitted and not working correctly?

I idly wonder...

Could it be that a rain-sensing car has had a non-rain-sensing 'screen fitted in the past in error?

That's exactly why I suggested sending the VRN through so that I can check what it should have fitted. it could be the wrong screen or a non working or badly fitted sensor.

A XC60 should have an actual button on the stalk to arm the rain sensor. Should be pretty obvious

I had much the same issue in March and decided that it wasn't worth the hassle.

On my Volvo not an XC, auto wipers is a button on the front of the right stalk, once pressed a symbol appears on the info display between the instrument cluster.

I also find it works quite well except when the windscreen has been polished as it gets confused and they come on full blast.
