Is he the registered keeper, or was the offence close to the date of a keeper change?
In short, yes they should be issued within 28 days unless he was driving a lease vehicle, or if the DVLA information is wrong or delayed. They have up to 6 months to issue though - http://www.legislation.gov.uk/uksi/2005/2757/regul...

You have to admire the chutzpah displayed here. If an agency of the state (DVLA) is dilatory in responding, another organ thereof (LA) is given an inordinate amount of extra time to still pursue you.
