Hi guys,I think I already know the answer to this question but just wanted to clarify it. I was pulled over the other day by the boys in blue,I know everyone says this but I really wasn't on my phone,I was looking at the time on it,the officer even agree I wasn't. He kindly put me up for an awareness course,but I have already done one in the last 6 months so will probably end up getting points. My question is,is it worth putting up a fight? (Not literally) LOL

Probably not. The offence is "using" not "definitely making or receiving a call on". Anything which involves holding the phone can be classed as using.

This just says USE.

you were using it to check the time.

Maybe try to book the course at a different place to avoid them noticing you are a repeat "customer" ?

Clearly the officer doesn't agree or he wouldn't have put you in for the awareness course.

Also, you've been on a phone awareness course before? At least learn your lesson (look around before using your phone).

I think you're going to have to suck it up. Might be worth asking on peppipoo though.

OP, are you actually saying "I honestly wasn't using my phone but I had picked it up to look at the time"?

Because if so, you were "using your phone". The tell the time. The law doesn't discriminate between making a phone call, sending a text, or updating your Mumsnet profile.

I always go on the premice that when i am driving and the phone goes or a text alert or something , i ignore it until i am ready to pull over in a safe place and then i always turn the car off and remove the keys before even picking it up. i used to be a van driver and used to get bkings from the transport manager that i was hard to contact. I told him i refuse to answer while driving and he would have to wait, alternatively they could fit hands free in the sprinter vans. I was told that would be too expensive.... my reply was then you will have to wait until i am on a break or pull in at a services etc before getting a call back. Not about to risk my licence for any muppett who couldnt be arsed to fit the appropriate means of contact. As far as i know even holding a phone while driving is endorsable. even now as self employed i refuse to touch a phone while driving. it winds me up no end when i see others doing it too.

Thanks for the replies chaps,th be honest its my own fault but just wanted to see if I could bull plop my way out of it! Damm Essex police and there unmarked cars!! LOL

Maybe the transport manager should also read the law.


(2) No person shall cause or permit any other person to drive a motor vehicle on a road while that other person is using—

(a)a hand-held mobile telephone; or

(b)a hand-held device of a kind specified in paragraph (4).

It's still a little bizarre how many people I see in new BMWs, Range Rovers, and various vehicles that will clearly have bluetooth built in but still drive along holding their phone to their ear.

I get that not using the phone is smarter, but when you have bluetooth it's a little odd not to use it.

I think seizing the phone would be more effective. Phone & sim to be returned upon payment of fine equal to the new price of the phone. biggrin
