Well huge bump to the thread!

After fighting this and fighting this I am pleased to say I have won the case!

After my solicitor had obtained the Police report from the incident it was indeed confirmed the HGV driver admitted 100% liability on the scene to the officer attending.
So glad all this is over, my advice to people out there. It’s a lot of bloody hassle but worth it in the end!

So if I understand correctly, the lorry driver admitted liability at the scene to the police then later changed his story causing no end of hassle and cost to both insurance companies.

It took making contact with the police to get his original story and get this solved.

And the lorry driver just gets to carry on with his life with no consequences?

I'd imagine his employer might have actions with him if it was a costly case.

50 / 50 seems to be the way a lot of the time now, one of our vehicles (coach) had stopped on a narrow road as he saw a van coming the van didn't went up the bank and hit the side of our stationary vehicle. The insurance are saying 50 / 50

One driver says one thing, the other driver says the other thing - there's no way to prove who's lying.

We had cameras showing our vehicle at a standstill

My insurers tried to go 50:50 despite the third party and their insurers claiming 100% of the liability. Then when I renewed 6 months later they still tried to claim it as "un-resolved". Honestly, they wonder why people think they are useless.

Had to fight with such a claim several years ago now. It took around a year!

Very hard to make out and looks rather slow (It wasn't that slow!) but this chap who turned in front of me leaving me wedged under the front of his van with his engine destroyed and my car written off went on to say it was my fault! He said he was waiting in the middle of the road, turning right and I just came up the road and smashed into him.

Despite pics of the debris and fluid trails in road etc, it took that poor bit of footage to allow me to win the case. It was 50 / 50 otherwise. They started questioning the lack of white lines etc, etc, etc.

All I can say is good luck if you wish to fight it :/
