Are these guys allowed to use a locksmith to gain entry to a residential property? My idiot brother has got an unpaid fine they're chasing and have told him they'll break in to remove goods, I wouldn't mind but it's my mums house!

Only peaceful means of entry or via opened window IIRC???

Eviction i think they can though?

It's for £890 for a fine for doing a wheelie. I'm trying to get it through to him he'll have to give them his car if it comes to it.

From my extensive knowledge gleaned via "Don't Pay, We'll Take It Away" on C5 no they can't do it for debts but they can for repossessions.

Unless it's on finance, then they can't take it.

Yeah if the car is accessible they can clamp and remove it, unless he doesn't own it and can prove it.

I don't think they can enter your Mum's house for your brothers debt. That would be trespass. Also, there's some right bks on tv at the moment. They try to scare the property owners into providing receipts etc when they're not even the debtor! That's bullying and they have no right to do that.

Interested in this. Previous tenant in my flat ran up debts for not paying speeding fines and parking tickets. Also not helped that his car is still registered here so anything new just gets ignored.

Have had 2 visits from enforcement agents, they both left hand posted letters. Both saying goods will be removed. The first one I phoned and said he doesn't live here. The bloke believed me and hasn't come back. The second guy didn't care and said he was coming back 'one evening this week to remove goods'.

Have stayed in all evenings so far just in case they do attempt to break in.

You wonder how disgusting someone has to be to take a job like that. They're about on par with 70s sex offenders.

I have the same problem. Tenant from over 3 years ago running up fines with her car still registered to this address. Even though I've supplied them with her details (out of anger) and proof I am not her, they say it's not good enough and are gonna keep calling and visiting me.

Meant a summer of having to lock all the doors and windows if I so much as went to use the loo. fking morons!!!

We were told by the agency he worked for that if we supplied a utility bill, rent statement or lease in our names then they'd stop calling. But there's absolutely no way I am sharing that much sensitive information with them! I just tell them to check the electoral role as I don't want to be connected with the guy.

I've even tried to phone the DVLA and have them remove the car from the address but they won't as the owner needs to do it. Luckily we're on a first floor flat behind security doors so windows aren't a problem but if other residents let them in the main door then they can reach our front door to get entry and take goods.

I don't have the guys new address or contact information to pass on to these agencies and even today a new parking ticket came through so that'll be another enforcement visit in about 8 months.

Why has the court got your mum's address for your brother? Is/was he living there at the time of the offence?

Bear in mind this will be a magistrate's court fine the enforcement agent is chasing, not a civil debt. Your mum needs to have a word with your brother before it gets out of hand.

Thing is though they see the side where people deny the debts, argue the toss, resort to threatening behaviour, say they can't possibly pay, swear on their childrens' eyesight and then, when push comes to shove, to use a LockStockism, pull out a roll of notes fit to choke a dozen donkeys.

One of my old drinking buddies got a job with the council collecting rent arrears after he'd lost his job in engineering. He worried about the collection from people who were clearly struggling and how he'd cope, let's face it, he'd just been made redundant himself, so there but for the grace etc. ; until part way through his first day. Obviously they'd selected some usual suspects as his first jobs during training, after three of those all sympathy had pretty much evaporated.

That's a bit extreme. Wait until you're owed money and need to make use of the services of the court. Very useful people to have when there are so many people who are dishonest and feel it's Ok to ignore debts. I've used the High Court Sheriff ( http://thesheriffsoffice.com/high-court-enforcemen... ) in the past to very good effect. They usually get the money you're owed.

I'm sorry, but just how sensitive is a utility bill when it comes to getting rid of any such hassle? We all have utility bills, it's not like you're offering up your families medical records for global publication.

Given that a significant number of people who are serial debtors are liars and charlatans, I'd be happy to show a bailiff that their information is wrong and get them off my back.
