In regards to the DVLA one I can help as I have had exactly the same issue, the information you have from the DVLA is incorrect they can remove it without the owner, but you need to send a covering letter along with any documents you have received from the DVLA in their name requesting it to be removed. If you want confirmation of it's removal then you need to ask for an acknowledgement from them in the letter as well confirming your name and address.

Sign and date it, I would make doubly sure everything is clear to them mind as mine took 6 weeks to be sorted (originally quoted 3-4, but ended up chasing them after 5 and got told between 3-8 weeks now, at the 6th week it was all sorted), and confirmed doubly that they had removed the previous tenants vehicle (and equally not any of mine!)

Address for the covering letter and any documentation you have from DVLA for it's removal needs to go to:

SC Department, DVLA, Swansea, SA99 1ZZ.

SC Department is the Sensitive Case Department at the DVLA....

Bear in mind this will be a magistrate's court fine the enforcement agent is chasing, not a civil debt. Your mum needs to have a word with your brother before it gets out of hand.

In one.

First of all my brother is a total and utter idiot. About 18 months back he got caught doing a wheelie while we were both out on our bikes, he got offered a course for due care and attention or similar, it was £100. He ignored it, got a day out in court and 5 points/£500 fine for his trouble. He ignored this too, resulting in the enforcement agents calling today. He lives in a room at my mums.

It's all done with now, as per usual someone bailed him out and paid the debt, so he'll carry on living his life not taking any responsibility for his actions.

Thanks all for the help anyway. He wont be wheelie-ing anymore as the bike was repossessed last year.

I'm sorry, but just how sensitive is a utility bill when it comes to getting rid of any such hassle? We all have utility bills, it's not like you're offering up your families medical records for global publication.

Given that a significant number of people who are serial debtors are liars and charlatans, I'd be happy to show a bailiff that their information is wrong and get them off my back.
It's more the fact that they wanted a utility bill plus a copy of my lease. I've had my ID stolen 3 or 4 times now and I'm not happy to email it to them.

I'll happily show the guy when he comes back, my worry is him coming back without me being here.

That's a bit extreme. Wait until you're owed money and need to make use of the services of the court. Very useful people to have when there are so many people who are dishonest and feel it's Ok to ignore debts. I've used the High Court Sheriff ( http://thesheriffsoffice.com/high-court-enforcemen... ) in the past to very good effect. They usually get the money you're owed.
Completely agree.

Obviously not nice to be (wrongly) on the receiving end of such a visit but unless you think that it's ok to just walk away from debts or rip people off with impunity, then how else does the innocent party get their money back.

I assume he has reached the UK age of majority. Maybe it's time mum had a serious discussion with him.
If that doesn't work kick him out. Otherwise it looks like he's never going to become a functioning adult.

Request a replacement v5 then mark the car as sold and send on the v5 to DVa and a made up name/address. Will cost you what £20 .

Certainly makes you realise it's never worth avoiding problems and trying to involve a 3rd party to "assist" so to speak.

A less scrupulous person might request a replacement v5, then ensure the address was updated to anything that wasn't the current address, perhaps to the enforcement agent's address whistle

I always find myself watching Can't Pay We'll Take it Away. Whilst I appreciate it's edited for TV so we don't see the full picture, whilst I do feel sorry for some of those who've just fallen on hard times a lot of others just take the piss and deserve to be turfed out. There was one the other night about a woman who rented out her house so she could move up country to take care of her mother, woman moved in with her kids and stopped paying rent after a few months. Landlady was in tears about the state her house was left in and the tens of thousands she'd never get back, tenant just strolled off to the council so you and me could pay her rent. Now that is truly disgusting.

Yup, tried telling them that, my dad paid his debt for him this time, next time it'll be someone else no doubt. I was hoping this incident would get my mum to give him a kick up the arse but I cant see it tbh. When it comes to it, they both say the same, 'he's our son' rolleyes

Totally agree. Seems like paranoia preventing the right course of action.

Cause nothing sorts out someones inability to look after themselves than a good kicking.

Giving him a smack in this situation would simply be to make the OP feel better, it wouldn't help the brother anymore than paying it for him would.
