Yes, you can MOT it. Yes, he has a V5C for it now. But you will not get a new V5C for it.

'I know there will be no problem as the car will get a v5. If you feel that way pease leave it as I don't have the time waiting for the v5 etc to come back. It's not my car at the end of the day soon as it's sold il just forward the money.'
I sincerely hope nobody ends up being stung by this.

I think everyone may be missing the point here. When the insurance write a vehicle off they request the V5C from the owner and return it to DVLA, as from last October they will not issue a new V5C for a CAT B vehicle but this vehicle was issued with a new V5C at least 5 years ago, I think its only vehicles written off since last october that will be affected by this ruling anything that was already reissued with a V5C should be ok.

Correct. It is only vehicles declared either CAT A or B after the 26th of OCT 2015 which have NOT passed the now obsolete VIC test that will be refused a new V5 from the DVLA. This car has passed a VIC test and was issued with a new V5 years before the OCT 2015 cut off date.
You would have no problem being issued further V5s/TAX on this car.
The V5 situation should be the least of your worries if you buy this car. Good luck to anyone that does buy it. You will need it.
