1mph over the SAC limit

The missus has been caught doing 87mph, 1mph over the speed awareness course qualifying limit of 79 to 86mph.

What is she likely to get, the points and fine or will she still be offered the course? She has never been on the course before.

How caught? If by police officer, unmarked car etc. then if they wanted her on the course they would have written it up as 86 mph.

Caught by one of the camera vans on the hard shoulder. The one I have warned her about many many times!

Surely the guidance is clear.

86mph or less and you get offered a SAC if you've not done one in the previous three years.

87mph or over and the guidelines say 3 points.

How do you expect them to draw a defined line between offering a SAC or points other than choosing a pre determined speed where the punishment on offer changes?

3 points and £100 penalty is easy. The hard way is doing the Speed Awareness Course.

You know that she doesn't qualify because she is 1mph over teh range at which they offer the course...so why ask?

Why not write and say , she is only 16mph above the speed she is allowed to drive, can you let her off all-together...why not?

You must have known the answer when you wrote your post.

She will most probably be given a conditional offer of a fixed penalty of £100 and 3 points. If she doesn't want to accept that she can go to court and ask teh magistrates to decide...but it still won't be a course, Magistrates can't award one and she is going 1mph too fast after all.
