Was casually opening up some letters about 11pm last night as i've been quite busy over Christmas and not been opening much mail up. One was from the DLVA. first line reads "Driving while disqualified is an offence for which you can be fined or sent to prison" I thought thats odd, next line says " Our records show that on the above date you were convicted of a driving offence and disqualified from driving. You must now return your licence to the DVLA".

My first reaction was that this must be some sort of scam so I put the letter down. I went back to it 5 minutes later because I thought it looked to real to be a scam and there was nowhere asking for any money. So I logged into the gov.uk site and put in my licence number in the check, to my horror it came up that I had been banned from the 23rd of november for an alcohol related offence.



Ive havent been pulled over for about 7years and have never had any points on my licence.

I gave the DVLA a call this morning and they took all my details and said they have sent the case back to the court that the disqualification came from and that I should expect to hear from them via the post. The guy I spoke too couldnt give me a timescale on how long it could take to be resolved and I said so can I drive again now..."no" not until they have sent me a letter saying so.

Fantastic start to 2017! I am now house bound by these idiots for an offence that I had nothing to do with. I have also been driving illegally since the 23rd of november until today.

The court in question is in Scotland...I live in Somerset, you think somebody might have spotted the error somewhere along the line before applying the ban hammer.

Has anybody ever heard of this happening before/ have any advice on how to speed this up other than calling the DVLA like I already have. Obviously this is an inconvenience as I cannot travel to work or socials.

Sounds horrendous. Presumably you are on the phone to Hamilton Sheriff Court yourself right now?

Hmm all very well them saying you can't drive till its resolved but for some people that could be the end of their job. For me it would be.
I would simply continue to drive if you are sure its nothing to do with you.

4 year ban....

fking hell. Hope you get it sorted, if your story is 100% then that sounds like a bloody nightmare!

TBF, it isn't DVLA that's banned you. It's a Sheriff in Hamilton who's banned you.

And four years? That's gotta be a repeat offence, surely? So shouldn't be too hard for them to find out who it should be.

If he gets pulled and has no paperwork to prove his innocence that's a day in the cells.

Dangerous driving will see a ban up to 5 years. Either way, before it can go to court a police officer must visit you and charge you with the offence. So unless you have been charged in the last few years I too would continue to drive assuming your insurance company are OK with it.

OP, do NOT drive!
He's not advising it, just pointing out that he'd risk it rather than lose his job! Got to say the chances of getting stopped are pretty bloody minimal - I've been driving for 13 years and 150k miles and never been pulled over. In fact I've probably seen a traffic policeman less than 100 times in those miles...

I agree with the "carry on and drive" - chance of being stopped is close to zero, and if you do happen to get stopped, it will get sorted in hours rather than weeks.

Having never been nicked for drink driving, what level of identification do they need? I was last nicked for speeding 16 years ago, and just handed my licence over. This does not feel like a simple "error" - the addresses match, the licence matches. If it was that easy to book the wrong person, it would be happening all the time. I would be slightly suspicious of identity theft.

But the duration of the ban suggests it's a second offence (minimum 3yr) rather than a first (minimum 1yr).

Unless the OP has a previous drink ban within the last decade, then that would suggest that the miscreant in question has previous - so how come they've picked that up, but not the right licence?

The other alternative is that it was the OP, but he was so pissed that he doesn't even remember being in the area, let alone stopped...

about 15 years ago i applied to dvla to have my licence replaced , which i had mislaid. when it came it had six points on it. they were nothing to do with me.
once i managed to talk to somebody , the matter was resolved , but it did take a few months

It was not me I can assure you of that and I have no previous offences. Court is closed today as previous poster mentioned. brilliant!

I'd carry on driving too , its obviously an error and can be sorted at a later date

you have done nothing wrong , carry on as normal
