I feel like I have the right to ask them how this has happened and been pinned onto me so easily. Ill feel slightly aggrieved should they just say, "its all sorted now"

Also, rather scarily. Has this other "Thomas Smith" thats been banned, still been driving for the last month as he still has his physical licence and the DVLA have not changed his status to banned. Hes potentially been to court, given a 4 year ban, got his licence at home still and looked on the gov.uk website where it says his licence is still valid so is still driving.

Just had a call from the DVLA saying that the ban has been removed from my record.. Interestingly they are still blaming the court for sending them over incorrect information whilst the man at the court said that it was the DVLA that had done something wrong.

Great result for you but also think that you need it in writing just to protect yourself.

Frightening how this could happen.
DVLA are sending me something through the post in writing and in it apparently will be an apology for inconvenience. (but they are not taking the blame )

Wonder who will get the blame for confusing 4 months with four years too.

Just another update. My local MP has been back to me and said he has passed my email to him on to Chris Grayling (the secretary of transport). In the email I laid out everything that has gone on. My MP also suggested to send the story to the national press even though it is now resolved.

Said he wont pass it on until I say so but seemed to think it was a good idea.

OP, I'd be very interested to hear what reply you get from Chris Grayling.

I went down this route, for different reasons but DVLA related. The reply from the Sec of Transport was that they couldn't deal with the matter directly but had passed it on to the head of complaints at the DVLA.

If the same happens I'd also be interested in the DVLA's reply,
ta.
Will keep the thread updated

Any news yet?

Only I'm sleeping with one eye on the phone and one eye on the computer screen, and it can be tiring.

Luckily I am massively trained.
Nothing to report yet.

An update on this....

The DVLA called me on 04/01/17 to confirm that there had been an error and that they had wiped my record of any convictions and my licence was back to how it was before. I received a letter in the post on 06/01/17 confirming this.

I then received another letter on 23/01/17 saying "we have received details from the court about you disqualification form driving for an alcohol-related offence". I didn't respond to this letter as i assumed it was a follow up to not sending my licence back to them the first time.

On 02/03/17 I had to send my insurance company my driving licence check number in order to validate my new car insurance so I logged in to the DVLA website to get the information and was presented with the information that I was in fact still banned from driving.

I immediately called the DVLA and was told that they can see that the ban has been re-applied but do not know why. I was told that my information has been passed on to their court department and that they dont know how long it will take to be looked at. I have until 06/03/17 to send my insurance company the check code or my insurance will be cancelled so that will be more hassle.

I am now going down the route of the papers with this. I contacted my local MP again but he is out of office until the 6th.

Partly yes. He received a letter indicating that it was still an open item which he then ignored. These things do not go away if you ignore them.
I do partly agree with you looking back at it. But can you also understand why I assumed this was corresponding to the previous ban that I had been informed was now rectified both via a telephone call and via a letter through the post two weeks prior.
