As per the thread title, just curious of others experiences in the small claims court. What went on ? on what grounds was it thrown out etc etc

A lot depends on the mood of the judge on the day.

Their solicitor tried lots of scare tactics and used big words in long letters and emails to try and get me to drop my case. I pointed out my case was cast iron and i was looking forward to my day in court.

As doon as the court date came through they caved and settled.

I have taken on a dealer in the County Court and won the full claimed amount, costs and substantial damages for 'loss of quiet enjoyment' after they sold me a stolen car which the Old Bill took away.

I would imagine loads of people have lost, more than likely down to them being massive tts and seeing non issues as major issues and expecting compo for nothing

I took Suzuki to small claims. There was a recall on the drive shaft. Recall was done. Was in France and it failed again, so took them to court for the expenses caused for it breaking.

Different subject, but we had a guy who took us to court for unfair redundancy (unfair dismissal) we offered him £10,000 to settle out of court, he wanted £70,000 we then offered £12,000 on the day of the hearing he again refused, we lost the case on a small technicality and he was awarded £450 by the judges!!!

I was taken to court over a car I sold that blew up.


The chap wanted over 2k for an engine rebuild, Judge awarded him £400.00 So I lost and won, sort of.

different tale, but same lines:

many years ago a lady worked for me. Permanently on the sick, screwing the system. He sister, a copper was the same. her father, builder, the same. the entire family were a nightmare. Professionally employed, but professionally on the take is a good way to describe them.

The WPC successfully had a pay out for breaking her wrist whilst on duty. Got something like £40k (in about 1998) and left the force.


By chance I was reading a copy of "legal advisor" kicking around at work a year or so later.

The WPC went after the force for even more compo. Judge reviewed it, decided the original award was far too generous and slashed it, at least by 50% from memory.

couldn't have happened to a nice family.

A friend (yes, a friend, not a 'friend') took a dealer to court.... and lost.

It was many years ago but the story went something like this:
My friend bought a car and there was something wrong with it. Supplying dealer refused to acknowledge/rectify the fault (can't remember which). The problem was rectified at another garage and my friend sued the supplying dealer for the cost of the repairs.

She lost the case on the basis that the garage which undertook the repairs was not proven to be independent - i.e. they could have been related to my friend. Therefore, as the possibility of bias existed, the case was lost.

(the details here might not be 100% accurate, but you get the gist)
