I could only presume if it is marked for repair they have therefore confirmed that there is a defect serious enough to warrant repairing, if this isn't repaired in a reasonable time one could consider the council negligent...

Kent CC has a web page on which you can report potholes which also shows which ones have been reported. Surrey might have similar.

Is this not a perfect example of the com pen say shun culture.

You drove through a chuffin big highlighted pothole and you want someone else to pay for your driving mistake - i.e We the Taxpayer.

One has to wonder what the cost to the council would be to respond to a claim, consult an in house lawyer and process a payment - Probably 10x the cost of repairing the wheel.

Meanwhile on another thread people are complaining about council tax rises.

No, its fking not ! If they want to charge me ridiculous amounts of council tax, they can pay the £600 odd quid for the replacement wheel/tyre.

That's not including the obstacles/time involved to get it paid.

If its marked up for repair then the council can't deny knowledge. Therefore they shouldn't have left it in an unsafe state.

Just as a matter of interest, is there any level of cost of wheel and tyre that it would be unreasonable to expect the council to pay for? For instance, the wheel and tyre on a very exotic car, cost running into four figures?

AFAIK if it's marked for repair then your chances of getting a payout are virtually nil.

Doesn't mean it's not worth trying though.
There's a pothole on my way to work that's been marked for repair since at least September if not longer (they've repainted it once, and the second one is fading now as well). I know it's there so I can avoid it, but I'm pretty sure that the fact it's been noted but ignored for so long means you'd have a pretty good chance of claiming.

Ask the council for their inspection records to see when it was noted
Then ask for their repair policies to see if it was left longer than the time period set out in their policies. Irrespective of whether they knew and marked the hole, it should still be repaired within the guidelines.

I got 150 quid off Surrey council 11 years ago for something similar.

They make you go through the motions and ask for service history of car, mot, insurance and all the rest of it then they send you a generic letter back saying get stuffed after they've asked you to get repair quotes.

I was so furious I was on the verge of suing them, and it was only when I sent a letter before action that they wrote back, without prejudice, offering me 80pc of the cost of the repair , which I accepted (I think the repair bill came to 120 quid or about that)

So be prepared for a dear john letter.
