Caught at 100mph on m25

Hi everyone.

I got caught doing 100 on m25 by them new speed cameras last year. Today i got a letter from the essex police asking to plea guilty or not guilty (bare in mind this is not the NIP). After looking on the internet, I understand that i looking at a ban. I have had a clean driving record this is my first offence. Im starting a new job soon where i require my driving licence. Also my mum is disabled and uses a motability car. If i plea guilty and write a letter explaining these factors for mitigation, what is the likely hood of me getting just points and not a ban?

Have you had an NIP at all or is this the first you've heard of it? How long have you had your licence?

I had an nip i got it with in 2weeks of the offence. I had my license sinse 2007

I had the nip within 14 days of the offence. Been driving since 2007

I guess you have to plead guilty and go to court. I'd suggest getting someone with proper legal training to represent you. The fact that a family member uses a Motability car will have no bearing on the outcome I shouldn't think. Do you have any dependants? That can be seen as a reason not to ban if it would cause them hardship.

Might be worth getting an idea of the likely ban from someone who would have a some real knowledge AGTlaw etc?

That way you'd know what the issues may be for your new employer? Many could work around a short term issue, but maybe not a longer one i'd imagine. Unless you"re an HGV driver!

im a security officer at an airport and part of my job is to partol the runways in a car

I expect you'll be given a short ban and a tasty fine.

100 on a NIP is 110 on the clock. So you were motoring.


Claiming that you'll "loose" your licence and "loose" your job won't cut ice in the same way that claiming you were "a bit high" when you killed your mate.

According to this http://www.drivingban.co.uk/drivingban/speedingoff... over 100mph is a ban, were you over or exactly 100?

As others have said, seek legal advice.

I've always thought 100mph or over and its an automatic ban. Perhaps having a clean license for the best part of 10 years, needing your license for your job and finally being a carer for your mum may give you some leverage. As others have said, i'd recommend seeking specialist legal advice.

IANAL but...

I was caught at 106mph in Scotland on a Motorway. Good conditions, dry bright day, light traffic. I got 6 points and £500 fine. I represented myself. I was very apologetic, had a clean licence, and had letter from work saying that it would really affect the business if I was to get banned. I was lucky.

A few years later I got caught on a dual carriageway at 98mph ( yes I know, I hadn't learnt ) and got 5 points and a £400 fine. Again, my licence was clean at the time. This time, I did not attend court, but wrote a letter apologising to the court and pointing out my clean licence etc.

If I were you I would plead guilty, but not attend court (you don't have to). Write a letter apologising for not attending due to work commitments, be very apologetic abut the offence, and if you can include letters from anyone who would be affected by you not having a licence that carries weight.

Often if you're on the cusp of a ban and do not attend in person, they will give you points. They cannot ban you unless you attend, which would mean rescheduling the hearing. They're not keen to do this generally as the system is already strained and more often than not they like to conclude matters on the day.

Not necessarily a ban...

I was pulled over by an unmarked car on the M25 11 months ago, was in Guildford Mag's court in September. My recorded speed was 105-110mph (105 on the paperwork), I also received a S59 at the same time. I walked away with 6 points and a fine equivalent to ~30% of true gross weekly income, 1.2x net weekly income declared (true income tweaked via salary sacrifice in the month leading up to the court date so could be proved if required - in reality never questioned).

Speak to AGTLaw on here, he sorted out my mitigation statement for a very reasonable fee which I simply read out in court.

I did have a clean license prior though (beyond another SP50, 3 points ~5-6 years before)

Bear in mind that magistrates are all different, and at 100mph you're in ban territory.

The key thing with mitigation is to demonstrate how a ban will adversely affect OTHER innocent parties, and not to suggest that you will suffer if they ban you. It's a punishment - it's designed to make you suffer, but they don't want to punish innocent people that rely on you to have a driving licence.
