I think you need to read cmaguire's post again and then it might click into place... or .. do you believe in God?
Thank you, I read it again and it hasn't changed since the last time I read it!
I'm an atheist.
But I'd still like to know where someone has said that it was dangerous to drive at that speed?

Nobody I should think, unless you're North of the Border when some idiot might try it on.

I think the OP knows they've screwed up and if they have any sense, they'll get some legal help/advice and then cross their fingers and/or pray...
On a related note, regardless of whether the OP gets points or banned, they'll need to let Motability know as it could have some serious implications regarding the agreement http://www.motability.co.uk/contact-and-support/fa...

Always fun to read through the usual pointless arguments about the rights and wrongs of speed limits, and acceptability of breaking them.

OP, some points:.

Contact a good legal person to help with your mitigation statement. Get it right, and you have a good chance of avoiding a ban. Get it wrong, and you'll find yourself off the road (and maybe out of a job)

Second, ensure your 'motability' car is all above board and properly insured; because I've picked up the following things from this thread:
1. You wasn't driving the motability car at the time
2. The motability car is in your mums name, but she doesn't drive.
3. You're insured on motability car as a named driver.

There is going to be a discrepancy between your insurance state and your proposed mitigation assertion that your mum is dependent on you to get around. As a named driver, this implies you are not the main user of the motability car.

So either you are the main user of the motobility car and your mum is entirely dependent on you, in which case you are potentially committing insurance fraud by only being a named driver OR you are not the main user of the motability car, your insurance state is perfectly fine, but in which case if you assert that mum is dependent on you having a license, you will opening yourself up to a charge of Perjury.

Work out which is which, and ensure everything is legal; and don't lie to the court unless you like the idea of a holiday at Her Majesties Pleasure.

The Preaching Pompous Pricks of Pistonheads are at it again! rolleyes

OP, contact AGTlaw or similar for legal advice, and expect 6 points & a fine as per the few people posting who have been through this before + the Essex Newspaper clippings of people done at higher speeds then you.

Plenty of evidence at you getting 6 points + fine at worse, not seen any evidence of a ban actually being handed out for 100mph on a motorway? (short of googling specifically for it...)

+1 on checking the Motoability car setup, if you try and use it as a defence make sure you are standing on 6 feet of concrete!

Lots of bans have been issues for 100mph on motorway, could go either way.

Hi everyone.

I got caught doing 100 on m25 by them new speed cameras last year. Today i got a letter from the essex police asking to plea guilty or not guilty (bare in mind this is not the NIP). After looking on the internet, I understand that i looking at a ban. I have had a clean driving record this is my first offence. Im starting a new job soon where i require my driving licence. Also my mum is disabled and uses a motability car. If i plea guilty and write a letter explaining these factors for mitigation, what is the likely hood of me getting just points and not a ban?

Thank you

Fizwan
Ok I expect a ban maybe 6 months. Worse case best case 6 points and a big fine, if you have savings or decent income.

Your disabled mum, does she live with you? Does she drive the motab car? Does she rely on your income?

Your only hope to avoid a ban is that she lives with you needs your income and you to drive her around. You may qualify if the court accepts for exceptional hardship but its a bit of a long shot. Might be worth paying £250-500 for solicitor to come with you.

The fact that it will mess up a new job is tough in the courts eyes you must of been flying passed folk as M25 is known to be covered with speed cameras. If your a stretch of road and you going 30mph plus faster than everyone else its worth thinking about why!

Its will be soon very difficult to do 100mph without getting court as all motorways are getting HADECS cameras and anything over 80 in 70 and bang!

True, I was just figuring on the balance of probabilities in this thread, ie the general experience posted about so far seems to lean heavily towards points & fine, instead of a lengthy ban & fine.

It depends on the region. I was caught at 103mph on a 70 8 years ago and got 6 points and a big fine. HOWEVER, the solicitor stated that fine and points would be preferable to a short ban, since either were on the table. I know a few people who preferred to have short bans as punishments and got what they asked for.

I can't be the only one that thinks Fizwan may be trolling us all with a great deal of finesse, based on use of all the most common comedy miss-spellings ("sinse", for example) and a topic that's guaranteed to coax out the most strident members of the keyboard army

Do you just make up stuff? Magistrates guidelines for speeding at 70 in a 100 limit is:

magistrates guidelines said:
Band B fine (75 – 125% of relevant weekly income, typically 100%)
4 – 6 points OR Disqualify 7 – 28 days
So worst case is 28 days ban, highly unlikely to be that high, and best case is 4 points.

As said before, say you have a dependant who you drive for and they'll probably go for 4 points. The preference is points at 100, especially as its a first offence. 101 it changes.

Ok so my ban length was off.

I have know someone get a ban of 6 months for 107.

We don't know how the op is? they are guidelines but are mags really dishing out 4 pints for 100 plus.

I would expect a ban for a month and anything else is a good result.

A 28 day ban is the absolute max they can impose. First offence, if good character, suited and booted and full of remorse, no way will they get that.
