Interesting question to which I don't know the answer but:-

1) Order tickets online, and pay for them. Company says no order, it's ok for them to cancel.

2) Order a car, pay and then you cancel before collection as no contract has been formed.

I would imagine the garage would see this differently to the ticket company even though same scenario

For some reason my previous reply was removed- the post i quoted got removed as well?

As a i said before, in my opinion, this type of company is basically touting and the sooner they disappear the better. The behavior in the OPs case suggests that they're no better. Whats the odds they put on the tickets at a range of prices to see what people would pay and to get them hooked. Some people paid the huge fee, others paid the sensible rate which it turns out 'was a mistake' and are now being asked to pay the huge amount.

I paid £25 (£22.50 + £2.50 booking fee)
Apparently the ticket should of been £85 but to be clear the first i knew about this was when I recieved the email.

I guess there's no way of knowing the actual face value without seeing the tickets? Or do you believe the £85?

If im being honest I kind of believe the £85 the reason being it is a Jamaroquai concert so not a small time band and the seats are three blocks from the stage. I can see that when i clicked best available and didn't include the price range it gave me the best available as the incorrect price.

However i would of searched again had the price of been £85 for these tickets as only really wanted the £25 (which i am not sure where ever available) or the £45 tickets. The £45 tickets are not being offered to me as part of the deal i would probably take these as despite being far worse seats it would only be an extra £5 per ticket.

All this is in hindsight, and i stand by the fact that during the ordering process there was not the thought from me that i was getting them on the cheap nor did i take advantage of the price.

As an aside i bought some VIP tickets for a concert from Amazon last year for £150 per ticket which for some reason they couldn't sell me, without any prompting from me they contacted me stating they couldnt sell me these tickets but as an offer of goodwill gave me all of my money back £600 and also gave me 4 tickets with face value of just under £100. Shows the difference between a company who cares about it reputation and one who knows you have limited options. I believe they did this for a good number of customers as well so would of been a costly excercise for them.

Is goodwill gesture discount per ticket, or in total?
£15 off each ticket sounds quite all right to me.

The price i thought i was paying for the tickets sounds better though!

Im still awaiting reply from them and my order status is still showing order accepted so who knows what will happen. I certainly wont he paying £70 per ticket though.

Screenshot the bit where your order says accepted.

Contracts require consideration and a meeting of minds essentially - they offered a price, you accepted and offered a payment, they accepted the payment. Contract formed. Their T&C's might say things aren't set in stone until they accept, but you have proof there that they have accepted it!

You could pay the difference under protest and when you get the tickets sue for the difference.

Bit confused by this... so you went for the cheapest and a glitch/bug gave you the best seats and you actually noticed this by your own confession.

Now are bemused as to the company now stating they are sorry and the best they can do is £15 off the full price (probably breaking even), this is no different than using http://www.hotukdeals.com/ to get a £300 item for £30 then the company fix the site and apologise.

The only person who will lose out in this scenario will be yourself if you drag your heels and then its impossible to get a pair of tickets for £25 each as they are sold out.

You should be a politician! I said i thought it strange that the cheap seats put me close to the front not that i noticed a glitch and took advantage. Dont know if you've ever bought tickets before but often you get seats behind a safety rail or with a slightly restricted view which whilst near the front would be sold at a reduced price. So yes i thought it strange, but i did not think i was taking advantage of a glitch.

In response to the post above that one here is the screenshot, although to be honest its all irrelevant now as despite the fact that i had elevated this to STAR they have given me the refund and cancelled my order without speaking to me or addressing my concerns.
STAR agreed with the ticketfactory after the refund had been recieved but in my opinion they did not have all the facts as only a webpage to fill in in which they stated they would contact to get further info instead they contacted me to state case closed they agree with the decision.

pay the extra, enjoy the concert, do a charge back on your credit card after the fact for the extra 'under duress' payment using Section 75 of the Consumer Credit Act 1974
