If you consider this I recommend the following reading

Take a few points and a pisspuddle fine and turn it into a potentially life ruining ordeal.

Until they know who was driving, they won't know who the Fixed Penalty needs to be issued to.

If you complete the [s.172] declaration that you were driving and send it back, a Conditional Offer of Fixed Penalty in your name will likely be dropping through your letterbox at some point.
Thank you! that makes perfect sense, think i was just in a bit of a panic. it is just that for some reason says on a couple of different sites - solicitors sites - In 'minor speeding cases the NIP will be accompanied by a conditional offer Fixed Penalty Notice' and then goes on to say if this isnt the case contact us immediately - very good marketing that
Yes, this is what happened with my 72 in a 50. I had that 10 days of wondering. I have a friend who's a CPS lawyer and she was giving me pointers about what to go back and look for on the road as a way out in case it was a prosecution or got a bit severe, bless her! :-)

Hi All,

Feeling really uncertain so hoping you can help.

I was caught doing 43 in a 30 and just received the notice of intended prosecution.

How likely is it that the case will be taken to court?

Also i have been driving for under 2 years so if i get 6 points i will lose my licence. is this likely?
I did a speed awareness course on Thursday and they said someone driving under 2 years would have got 6 points.

For the same offence that you were given a SAC course for? I think you misheard.

For 43mph in a 30mph limit ?

As above, I suspect you either misheard or misunderstood what they were saying.

Hi, I have recently just received the same letter and am in the same position as you. Can I ask what the outcome was for you?

A long time ago, I got caught doing 51 in a 30 and got 3 points and a normal fine. Probably at the discretion of the officer. I genuinely hadn't realised the speed and was pretty humbled by it. Got a condescending talking to and the ticket.

I was only 18 at the time so it didn't go me any harm to get a kick up the ar$e about speeding.

Fingers crossed its just a 3 pointer.

Did you end up getting an outcome? Just received this letter and not sure what I’ll get.

Yes, exactly. Are you sure you want to take the points? You could pervert the course of justice instead, and maybe end up doing jail time.

Speed awareness course could be offered upto 42 in a 30 limit or a fixed penalty notice of 3 points and £100 fine will be offered upto 49 mph

I got three points + £100 for 49mph in a 30 over Christmas.

To me that is a lucky outcome, considering you were carrying 2.7 times the kinetic energy than at 30mph.

You don’t always have to bow down and pay the tax.

Points and fine are as per the law, so nothing lucky about it.

It's not a tax. There is no "war on the motorist". And quite frankly, I'd rather take the points and pay the fine than have to look in the mirror and think to myself that I sunk as low as those two st gibbons

That was a long time ago. The Hamilton defence as it became known was probably the catalyst for the bar being raised for a successful reasonable diligence defence, just saying sorry we both drove and can't remember who it was, alone, is very unlikely to be accepted today

There is unquestionably a war on the motorist, it’s happening today. The idea is to make driving as unpleasant as possible and price it out of most peoples’ reach. Unfortunately public transport where it exists is vastly worse and also more expensive. But still maybe when everyone is beyond twelve points they’ll have succeeded.

Plenty of viable defences to use, even today, just take a bit of effort, of course most have been terrified into rolling over at the first sign of a NIP and paying whether they are actually guilty or not.
