hello

just curious ;)

but say i got pulled by a unmarked car, supposedly doing near and estimated 99 mph on a quiet 60 when overtaking a slower moving vehicle, in a safe place, no junctions etc on a straight, I do not recall being given what the legal advisor says is a verbal NOIP what happens next?

is there a time limit for the court?

do the police have to make contact in the meantime?

what is the time limit?

if the police say the offender was doing "well over that speed" but their equipment only cought the offender at say, 99mph, where does it stand ?

ive never had a rum in with the police before in my life, will this go in my favour?

ive also had a full clean motorcycle license for 4 years also, owning a performance ducati, if I get a ban will this effect the bike lisence also?

1. You can argue the fact at Court that you were not given a verbal or later in time written NOIP and therefore should not be convicted. Your word against Bib re verbal.

2 An Information has to be laid within 6 months of the offence otherwise they cannot proceed. If laid then summons can be taken out and served at any time.

3. No. May greet you at Court.

4. Will give evidence of what he is sure of i.e. a reading on the device in use. Only on a follow can he say he was at max recording on speedo but being left behind.

5. Virgin licence does not protect against points being awarded. Depends on what mitigation you can put forward and whether Mags in a good mood for 3 or 6 and size of fine.

6. First offence, very high speed could lead to a ban and if offence committed in a car that ban will also apply to motor cycles.

Do I get the impression you are sweating and wet round the nether regions?

yeah its a first offence, and I just want to know what is going to happen. I need a car for work, to earn a living, and I really do doubt i was doing 99mph to be honest and they diden't show me the video.

I asked the officers if they thought I was driving dangerously "no" was I in full controll of the vehicle, they had a snigger and said "well yes" so I asked was I endangering other road users then they changed the subject.

basically I think it comes down to, young geezer, porsche, hes gotta be up to mischief.

and even if they dont send anything in the post they have done their job of making sure I drive like an angel now, i dont even go over 70mph on the motorways!

so if you see a dark blue porker on your travels, and wonder why its 1-2mph below the speed limit that will be me and now you know.

Ill prolly get pulled for suspected drink driving or other offences now because im concentrating TOO much on the roads.. .. ..

Another 3 mph less and you would have got a Conditional Offer.

You are going to Court, the summons when it comes will tell you when, for the higher speed and will have chance to give an explanation. This will give you a chance to mention the above fact, clean Licence,that there was no danger, you now realise the error of your ways etc etc and importantly a ban would cause undue hardship and loss of job. A letter from your employer would help in this respect. The Magistrates have the power not to ban if hardship can be proved.

I think you will probably get a fine and 6 points, maybe.

Did they actually say they where going to do anything, or did you get a quiet word in your ear, take it easy or similar? I expect that you would never hear any more after that (you got me paranoid now!). What makes yo think you are going to court, have you got a summons?

Verbal NOIP is

"You will be reported for consideration of the question of prosecuting you for......"

Thats all that is required.

NOIP served!
