Last weekend got a summons through. I got caught doing 99.13mph on the M23 by an unmarked Evo back in march and was issued with a producer, which I promptly forgot about until the summons plopped itself on the floor.

Now I'm being summoned to be charged with:

1.Speeding
2.Driving without a licence.
3.Driving without insurance.

BiB say that I have to have my day in court, and that the judge may increase my fine and points. Also said I'm not the first to forget, and won't be the last.

Do I really have to waste even more police time by doing this, as I'm not contesting the speeding and can prove that I was insured and permitted to drive?

Any tips on what to say to the judge - there are no mitigating circumstances other than my own forgetfullness.

TIA

Did anything contribute to your forgetting the producer - i.e. were there mitigating circumstances such as family problems, etc.? If so, the judge might be more lenient I would imagine.

Nowt mitigating other than it happened on the way to Oxford for a few days, being unemployed and worrying about that.

I don't want to look like I'm making excuses though.

Just confirming that the summons are for three offences only:

>>>>>>Now I'm being summoned to be charged with:

1.Speeding
2.Driving without a licence.
3.Driving without insurance. <<<<<<< ???????

For speeding you will be required to either forward your DL or produce it at Court as it is an offence which carries obligatory endorsement. By producing this will show that you had a current Licence so on this you plead Not Guilty. (You do don't you?)

At Court you plead Not Guilty to the Insurance offence and produce the original Certificate of Insurance covering the use of the vehicle in question on the date of the speeding offence. (You did have Insurance didn't you?)

I presume amongst all that paperwork are not more summons for (1) Fail to produce DL (2) Fail to comply with conditions of DL (L Driver) (3) Fail to produce Insurance. All alternatives are covered. Is so and Licence substantive then its Guilty Yer Worships and into your speech of mitigation as to why you did not produce.

I was charged many moons ago for no insurance; actually for two offences;

1. No insurance
2. Failure to present insurance

The insurers were slow to issue the documents so I was found guilty of no. 2 - £30 fine at the time (c1990)
