Proof of what? I'm not disputing the OP's story in the slightest but how does that prove you drove home after the first visit and back again for the second? It doesn't prove you didn't leave your car in their car park in between the visits.

That is technically correct but you would still need to provde the evidence on request and if you do not do so before proceeedings are commenced then you may be liable for Horizon's costs if you produce it subsequently.

In the meantime if you want to be difficult then that will not increase your liability for any of Horizon's potential costs.
Erm, small claims court, not really a costs awarded thing. And he discloses his evidence when he files his defense.

Costs can be awarded for unreasonable behaviour. Rare but not unheard of. For example, defendent allowed a claim to go to trial when he had exculpatory evidence he chose not to share earlier that would've avoided one.

For those who are concerned I am getting angry, worked up, my blood is boiling, and that I should just hand the evidence over and move on with my life... Please do not worry.

As soon as I opened the letter from Horizon I just laughed as I knew immediately it was a cock up by them.

I knew that I could solve it in minutes, and that I would never be paying a charge.

It’s all good.

As I mentioned, they just irked me somewhat in their response, and I am doing this for my own amusement, to see how far they will go and what they will say.

Everyone needs a hobby right? smile

Double dipping where the cameras have not picked up an entry/exit. And you would be surprised at how many people will roll over and pay up and the PPC gets free lovely money (I call it theft).

3 ways to deal with it:
(1) Appeal to the supermarket
(2) Appeal on the PPC website
(3) Appeal on the PPC website with the simple defence "I am the registered keeper of vehicle AB12ABC, but was not the driver at the time and I will not be naming the driver. Please send a POPLA code if you disagree". A POPLA appeal will cost them £25.

I would personally like a law where if you appeal because they are wrong, you get paid whatever amount they are trying to charge you.

Its actually a known flaw with many of the anpr systems, i had something similar a few years back when i called into the services on the m6 toll on the way to where i was going and then also on the way back. There was a difference of about 8 hours between the two visits but it registered i had stayed at the services all day.

Its something called double dipping and simply mentioning it in an appeal should be enough on its own to get the matter dropped.

I'm presently in receipt of a similar ticket.

I overstayed in an (unknown to me) three-hour limit car park at an out of town retail park. I was looking to get a new sofa, and visited several stores on the retail park before eventually purchasing one. Unfortunately for me, sofa shopping especially when combined with lunch (in the retail park) is not a quick express shopping trip. At no point did any retailer point out to me that my time was limited, or have clearly on display any terminals to enter my reg.

Any ideas if I have any leg to stand on here?

Screw them as much as possible

Horizon run the local carpark near us. I parked in an open bay while the supermarket was having some work done. Came back with my shopping to find I had inadvertently blocked a bus.

Apparently there had been barriers in place but they weren't there when I parked. The man from horizon hadn't written the ticket and got abusive, I decided to leave, as I opened my door and got in, he moved to stand so I could not close my door, all the while still holding up the bus.

Bit of micro manoeuvring I got the door shut and drove off.

Tin pot tosser.

Mind you, a neighbour had a proper parking ticket and wrote a letter with the payment about how he wouldn't even piss on the warden if he was on fire.

Warden started proceedings and the Police got him to write an apology under a community resolution order thingy. The second letter was hilarious, waxing lyrical about the valuable and heroic actions of our traffic wardens and finished with the line,

"and of course I would piss on you if you were on fire"

Out of the blue, and without sending my second response to them, I get this:

Having fully reviewed the case, I can confirm the Parking Charge Notice has now been cancelled and no further action will be taken in this matter.

Horizon invests in both the technology and infrastructure required to manage parking facilities on behalf of its clients. As with any technology, errors can unfortunately occur. Whilst errors are mercifully rare, there are a number of possible reasons why a vehicle registration may be either missed or unreadable by an ANPR camera. These can range from another vehicle driving too closely to the photographed vehicle during busy periods, through to a number plate that is obscured due to poor weather conditions or dirt. It is apparent that a capture of your vehicle has been missed on this occasion. When problems are highlighted to us, such as in this scenario, we are able to investigate and apply remedy.

Please note that once the Parking Charge Notice is cancelled the contact details are removed from the Parking Charge Notice and will not be retained for any purpose or shared with third parties. We are, however, required to retain images and appeal correspondence for a period of 2 years by DVLA and the BPA and are not therefore able to delet e these from our system.
