So. There I was. Pounding down the M4 as usual. Colleague in the passenger seat. Come to the 40mph roadworks limit before the Bath junction.

I happen to know it has a GATSO - but I slow to the speed limit for roadworks anyway.

So I'm doing 38mph in a 40. I'm doing it in Lane 1, of course. Red car whizzes by in Lane 3 as we pass the camera.

FLASH! FLASH!

Nice one, Stevie, its painted bright frickkin yellow and there are loads of signs saying "SPEED CAMERA" everywhere...

So now, of course, I am waiting to see if the nice man back at the Avon Safety Camera Bastardship actually checks the evidence properly before sending every registration number he's got photos of an NIP.

I have every faith.

I absolutely will go to court if necessary - they're not getting £60 out of me when I'm actually innocent and have a witness!

To add insult to injury some fecker on the way back - in Lane 2 - decided that he really wanted to overtake the car in front of him - despite the fact that I was alongside him in Lane 3. USE YOUR MIRRORS FECKWIT!

:furious: I thought it was only at the weekends they let the amateurs use the sodding roads. :furious:

And relax...

Dont worry you will be fine!

I think they would have to be pretty silly to assume that the car in the first lane is travelling faster than the one in the overtaking lane...

But, if it does come to it, I am sure the Crown will begrudgingly pay your and your witnesses costs at court. It will be impossible to prove that your car was going faster than the other.

Let us know how it goes though over the next 14 days, if you hear nothing by then you are in the clear!

Will do. It would make an interesting experience if I do need to go to court...

I had exactly the same experience there about a month ago.
Never heard anything, like you I would have fought tooth and nail.
Don't worry about it.

Makes you wonder if that driver hasn't registered their car, or is using a cloned plate!

I had the same experience on the M42. I pulled in after overtaking someone in the middle lane and notice a scamera so I moved over into the nearside lane and braked, as she sailed past me. FLASH FLASH and I pulled out again and as we went past her the wife looked over and saw the driver of the other car had her head in her hands I haven't heard another thing since.

Been through that section several times and I fail to realise quite how anyone can actually get caught there - but obviously they do (£1M in three months by the way).

You know, 40MPH signs. Speed camera signs.... markings on the road, yet people storm through that section at 60+.

What, did you not think there would be any speed cameras?

Par for the course with overzealous enforcement of low speed limits on carriageways with 2 or more lanes.

I quite agree, and also agree with the previous comment that it is usually a symptom of carriageways with speed enforcement.

My point was, for evidential purposes there would be no way to either show or prove that the car in the first lane was going faster if both cars are picked up on camera. In fact, the highway code would suggest that this would be impossible, and very difficult for the CPS to work around that without leaving serious doubt. So much so in fact that they wouldnt bother following the case.

With gatsos I would have thought it would be quite common that more than one car is picked up on the photograph. What would be more distressing than this situation if you were in the outside lane, and someone undertook you setting off the camera. I have heard of a few cases like this, where to add insult to injury the photographic evidence (as the flashes are not set off for the right car) that the person wrongly accused was travelling 20mph or more over the limit.

Then it would be time to find a good solicitor....

IIRC any photo with more than one vehicle in it is discarded, so I wouldn't expect anything. Maybe that's what the chancer in the outside lane was relying on...

You should be fine, thats the whole point of the white lines on the road so they can see the distance between the 2 flashes. I got someone a treat doing this a while ago, pulled up alongside a normal honda with bean can zorst etc at a set of lights where I know there is a 40mph speed limit and scamera the other side. As they changed I pulled off swiftly and as expected I heard the zorst blare away and he eventually came flying past me, I however had stopped accelerating and was at 37mph. We both got flashed but he must have been doiing 60+

[cynicalest mode on ]
But both car could have been over limit...they like money..........

[cynicalest mode off ]

But Don Liebchen - they say they calculate based on your drive over the white lines...you should be OK.

Erm, double flash?

2 pictures. The car that's moved the furthest between the two is the one going faster.....

...shouldn't be too hard to work out which one set the scamera off....

Indeed they do. So now I am waiting to see if they actually DO what they say they do. IF they do then I will hear nothing.

If they simply send bills to anything they've got pictures of then I'll get an NIP.

IF I get an NIP I will say I was driving. Deny the offence. And insist on an independent assessment of the evidence from the white lines. And bring my witness to court. And and and...

But only because I know I'm right. If I'd been speeding I'd take my lumps.

Its not as if I hadn't seen some "excellent progress" earlier. Its just that I slow down for roadworks.

It's more likely the Scumera Pratnership will send them both a FPN.....
