Got the obligatory letter today - 107mph on a 70mph road outside of Stonehaven. So my question is, what happens now?

No issue with the conviction as I was bang to rights but anyone got any idea about the usual course of action (e.g. banning)? Burning in Aberdeen city centre is probably in the list of possibilities - that's just something you have to accept while living in Scotland

In England, as a general rule, over 100mph is an instant ban, length of time determined by magistrate.
However, I have several work colleagues who have escaped 100mph+ bans by convincing the court that their license was required for their job.

I'm not sure if the law in Scotland is different.

First port of call should be www.pepipoo.com as they have details of previous scottish cases i believe.

Nice sentiment bang to rights but you must bear in mind Britain is not a sensible country anymore. Your best bet is report the car stolen and leg it out of Britain if you can. Either that or get a really good Lawyer and lie your arse off to try and discredit the ahem policeman. It is pretty stupid that nobody was even offended by your speed and you pottentially can lose your livelihood, perhaps even your home and your family. Yet if you go into town tonight and club some old pensioner half to death but claim its because your wife left you or your father abused you you will be looked after by the state. Definately its better to treat the scummy judiciary with the contempt they deserve and just lie, lie, lie. There is nothing honourable left in the UK at all now. The police are currupt and so are all the layers of government.

On a slightly more 'normal' and less ranty note...

I got done last year for 93.19 (why .19???) in a 60 by an unmarked car hiding in bushes. Licence was clean before that so I put on my best suit and begged forgiveness, agreed I was a very silly boy, said it was out of character (yeah right) and got £300 fine and 6 points. If you already have points, the rules may be different, but you could always beg for leniency. This was Hexham, who apparently are not awfully forgiving about such matters.
Alternatively, claim political asylum. Or join the police and get a chauffeur to claim the points on your behalf.

Best of luck and if it all goes pear shaped, I'll volunteer first to keep the car ticking over for you. :-)

Get a Solicitor ASAP.
IIRC, some forces in Scotland were (are ?) charging anyone caught doing over 100mph with "Dangerous Driving" also. Get over to www.pepipoo.com and someone will be able to help you. I reckon you're looking at a ban of 6-12 months as a minimum.

Well, they'll give you a small cell to share for a while with a large guy called Phyllis, who has a rather nice selection of lubricants...

Alternatively, you'll get a ban and a fine + points. But I should think it will be down to the individual case on how much/long etc.

I got caught ages ago so rules may have changed but they told me that up to 25mph over the posted limit was 3 points and standard fine, over this and it was court. I know when hobbit123 got caught he was told if it was more than 30 over he would have to convince them not to ban him.

Fingers crossed for you matey and hoping things are looking up very soon.

Hobbit - you can forget about looking after the car. I had to steal it before he let me drive it.

At that sort of speed, you will likely be required to attend court.
You may be able to submit a guilty plea by post.

The starting point for sentencing should be 6pts or a short ban (upto 56days) with a fine - about 1 weeks wages. This could go up or down according to mitigating or aggravating (wet? dark?) circumstances. As well as your attitude and circumstances. Community service and a big fine are an option.

A guilty plea and statement of remorse should give you a discount. A letter from an employer stating that your licence is necessary for work, and that the business will suffer as a result of a disqual will help turn it into points. This can only be used once, however. A subsequent offence will likely result in disqual.

This is based on the England and Wales guidelines as I understand them. Scotland may well differ.

Actually what will happen is this....

You'll be put in a cell with a 7ft tall 25 stone hairy bloke who will say
'Do you want to play Mummies and Daddies?'
You: 'Yes' because you are terrified.
Him: 'Do you want to be Mummy or Daddy?'
You: 'Erm....Daddy?' (Scared and looking for best possible outcome - grim I know)
Him: 'Come over here then and suck Mummy's C**k'

And thats it - the best you can hope for.

You'll have to convincingly pretend that 107mph is a very naughty speed to travel at in a straight line on an empty road & you're very sorry.

Do not attempt to introduce logic or common sense into the equation, e.g. German Autobahns no speed limit and narrower - less accidents. Cars have improved somewhat since speed limits set. "Over 100mph = ban" is not a scientifically deduced figure where the speed suddenly becomes much more dangerous and "banworthy".

Just go along with the act and theme of the court, you're a naughty boy and really sorry and deserve to be punished, anything else will upset the applecart!

Sad isn't it?

My licence has been clean for around 6 or so years but I was done for 96 in a 60 some time ago which lead to a court appearence (hopefully that won't be brought up). I'm guessing that court is the minimum and a ban is likely, I just hoped that the 100mph=ban was not an actual reality. This idea of being done for dangerous driving is a worry - as applicable as it might be.

I like to think I'm sensible with my speed as contradictory as that may sound to some. I've never been one to take risks but do enjoy blatting when I can see a clear road, not that that makes much difference to a speed camera. To be honest my "normal" speed has been creeping up of late so this is not a great surprise, and there is nothing other than my abject stupidity to blame re. getting it above 100mph.

I don't need my car for work although it is of obvious benefit to be able to drive. It's going to kill me to not be able to drive to be honest, just from a personal point of view, but I can't see that holding much weight with the powers that be.

@rse. @rse, dammit, sh1t.

Mate, I am the same as you in that my speed had been creeping up. If I were caught then I too would have no complaints. I guess its a chance you take. Not familiar with the road that you got caught on but will have a look next time I am in the area. Interested to see if it was in a dangerous area though.

Incidentally, I invested in a Snooper a while back and while this doesn't guarantee you won't get caught it at least gives you some idea of where the fixed cameras are and at the moment can legally detect the radar based mobile ones too. Worth the money IMHO and I never drive without it any more. If anything I have actually slowed since I bought it as it really keeps you on your toes around the accident blackspots and you can even set it to pick up schools - where I have never seen speed cameras.

Will be keeping fingers crossed you don't get a ban as I know how much that would hurt mate.

Thanks for the input folks. I'm going to see a specialist lawyer tomorrow to find out what to do.

I seem to remember that on the A90 [ main Perth - Aberdeen road anyway]
when lots of folks were pulling out of junctions, without
judging the speed of the traffic on the dual c/w,
the local council reacted by posting lots of speed cameras on the road,
instead of the more obvious and effective route of educating the local
drivers to be a bit more careful about pulling out into a fast road.

Mind you, that's how things work in Scotland.

I leave it to the concerned student that

a) the A90 carries a lot of oil industry traffic.
b) lots of oil industry folks have lots of disposable income
for fast cars.
c) the section from Dundee to Aberdeen passes through mostly
wilderness, with few settlements of any size.

Still they put up the speed cameras.
