Question for BIBs, Offence for Riding scooter/bike on path?

Hello,

I have a general question regarding the potential offence that a scooter/motorcycle rider could be reported for riding on a pavement in order to bypass a traffic jam in a narrow single lane road tunnel under thames in London? (East London dwellers may know this tunnel well). The pavement runs both sides of the tunnel and is shared by pedestrians and cyclists alike.

If there is a specific offence:
1. What is it?
2. Is it endorsable by points on the license
3. Handled by a FPN or by a court vist?
4. What the likely fine might be

I'd like to add this is purely for my information and I myself do not ever ride on the pavement in question. It just seem to me to be a particularly bad/wrong thing to do esp as the tunnel has CCTV. It is just that I see many scooter and motorcycle riders doing this everyday.

On a similar note, I'd be interested whether motorcycles are committing an offense by riding in designated bicycle lanes?

I was knocked off my bicycle last week by a rider cutting into the lane in heavy traffic on Lower Thames Street. (s)He didn't stop and I couldn't get the reg, but fortunately it was fairly low speed so no harm done to me or bike.

Hey Lambo - is there an offence for turning off all the traffic lights on the A4 this morning and turning West London into big traffic jam.

Or is that all part of the serivce, Sir?

I'm so glad I've shortened my commute from Reading to M4 Jc2, it's now Reading to Jc4 - totally different

Lambo - must have been dreaming about Rachel Stevens coming up north ahve you? Just didn't quite het location right, she's gonna be in Leeds tomorrow and I live near Chesterfield....

Yes all the traffic lights are linked to my sleep patten.......Whilst fast asleep in my bed this morning my grey matter linked to the A4 and stuffed your route up, sorry mate I will dream of Rachel Stevens tonight and maybe she will appear on the A4 to guide you...

Not sure if FPN as I do not have a comprehensive list but at a guess most probable.

Bear in mind that also a footpath can be classed under RTA as a road so other offences of dangerous driving etc could be considered. Likewise under Highways Act likewise offence of driving a carriage on footpath and other ancillary offences.

DVD: does the fact that cyclists are permitted to share the use the footpath (I'm assuming this must be the case as it too dangerous for them to use the actual road as its very narrow) alter its stance in this case based on your description of a footpath?

BTW Lambo, The tunnel in question is the Rotherhithe Tunnel.

Phoar sjt thar wants thee fowerpenneth...

As I understand it LA have the power under Cycle Tracks Act 1984 to designate those footpaths for which they are responsible as a cycle tracks over which the public have a right of way on pedal cycles and right of way by foot. These to me are pavements normally walked on with signing to the effect cycles permitted. If not so designated then offence under Highways Act to rise on the pavement(footpath).

Further those cycle lanes ON THE ROAD IIRC are created by a Traffic Regulation Order by LA and permit use only by pedal cyclists and which may have a limited time of operation which will (or should )be signed.
