NIP Advice please

Hi,

Not posting by my usual name! Have read forums for advice but got a few q's.

I have got an NIP for doing 83mph in a 50mph zone on the M4 in wales a week ago, received today. At least I think thats correct, it states "Excess speed 50 MPH Camera Device Recorded Speed 83mph". According to the welsh police website it was a mobile unit camera. I do not remember seeing anything and normally cruise about 85 on the M4 so I guess I just missed the signs etc. I think I am looking at a court appearance. I was in my sports car and have a sports car related personal plate so worried judge might take that into account.

Any advice on my options would be appreciated.
1) Ignore NIP. Will I get away with it due to lack of police resource to chase it up?
2) Admit it and plead guilty without a court appearance.
3) Admit it and go to court?
4) Say my sister (non uk resident without UK licence) was driving? Will they then drop the case?

IIRC the only 50 limits on the M4 in Wales are just before the bridge tolls and then near Port Talbot. There are currently roadworks near Llanelli that are supervised by scamera.

I would certainly remove any reference to your reg number in your post............. esp if plans are afoot

2. At that speed Conditional Offer does not apply and its a straight summons for Court where they may want to look at you with a view to a ban.
3. If no defect in signing or proceedure for you to contest then "Yes".
4. Very, very dangerous. Court case recently reported where it had been tried and culprit got a substantail priuson sentence.

If it's a potential ban I would say you have two routes.

Insist on the video. Riskly, but can get the case dropped. As you probably were doing the speed on the NIP, contesting it on a technicality such as the video is unlikely to work.

Run with the PACE defence. Basically a game of hard ball, I'm not up to date on how succesful it has proved to be lately however.

The third option is to buy a bicycle

Ok, it seems I will be getting fined and points/ban for this assuming once I have received any photographic evidence it was me in my car at that location etc.

As I was 33mph over the 50 limit it seems it will be an automatic court appearance, I would prefer not to do that, so my question now is, how do I limit the points/ban and fine?

The other option I have is I hold a foreign licence so I could return the NIP with a copy of that, but I think this will be an automatic court appearance, but I would avoid points, assuming they dont check to find I also have a uk licence!

Is it worth going back over the route to check for signs? I drove up the M74 last week from Carlisle to Glasgow, lots of roadworks with just the outside lane closed off, so we all had to use the inside lane, all but one were reduced to 50, one was reduced to 40 god knows why, and quite a lot didnt have the NSL sign at the end of the works.

So maybe worth checking.

You imply that whilst holding a "Foreign" licence you also have a UK Domestic Licence. Be aware that from the Court file they will enquire of DVLA and trace this Licence and will have done so before your appearance. Producing a Foreign licence you will be deflated like a bent balloon.

Consider visiting CAB and have a word with their Solicitor. Get him to outline your options under the Hardship plea. If you do a search, it was text book explicitly covered by Justinp on this site some time ago.

Caution. If no change in speed limit over the section of works then all that is required to mark the end of the temporary limit is a "Road Works End sign - sorry for the delay " Usual NSL sign not required.

The PACE response has at best a 50% chance of success, depending on the Constabulary in question, so could be worth pursuing. It's covered in detail on www.pepipoo.com so I won't expound here.

I myself used it on a recent alleged 39 in a 30mph zone (a 2-lane dual carriageway with armco both sides, before people judge) and have unfortunately just received a Summons. Ah well.

I would get the photographic evidence first to check where exactly you were done. The vast majority of mobile locations are on 70mph stretches, so if there is a temporary limit it may be worth checking signage as has been mentioned before.

In all honesty though, and this is from someone with a similar 'fondness' of scameras to the majority of people on here, if you admit to doing more than 30mph than the limit (if the limit is indeed correct and enforcable) then why be a cheeky sod and try to get off on some feeble excuse?

It looks like I have had an NIP from two years ago 'forgotten about' by the same scamera partnership, but only becuase I showed the camera was hidden, the road was incorrectly sign posted and there were no incidences of KSI accidents for the previous five years. Saying that your milkman was driving will just make them persue you harder and faster (no pun intended).
