My partner is being sued by her ex-husband, who is now claiming that she has his car.

My partner does not have a driving licence and she last saw the car in 2002.

As the car is foreign registered, what chance is their of tracing the car in the UK?

If it had been destroyed/scrapped would DVLA keep a record of the destruction of such a car?

Who would we write to in order to get evidence? Any ideas?

A few things spring to mind:

The ex will not be able to win his case because he will not be able to prove she has the car if she has not got it.

If you bring a foreign registered car into the UK as a permanent import the car is supposed to be officially imported and correctly registered with a GB issue registration. This should be done within six months. If the car was 'imported' illegally more than 3-4 years ago (2002) without re-registration then the owner (the ex?) may well end up at the wrong end of a court case himself.

If the car is still foreign registered then the DVLA will not have any records of the car, therefore will not be able to help you.

Thanks for the reply I just wanted to make sure we weren't missing something in terms of the claim.

As far as I know he has never reported the car stolen. We suspect he may have scrapped the car or it has been towed and that he is just being a w*nker.

Just a thought....but it wasn't registered in her name was it?

When I went through my divorce we had a car that was always mine (Mine, mine, mine, mine it's all mine) but stupidly I had registered it in my wifes name so even though when we split I took "my car" legally it was hers so I had to add it to my settlement with her.

Not registered to her, the guy is just looking for trouble.

He sold the car in 2002 for £300 to a mate, but then refused to hand over the keys and registration documents. We know the car disappeared around that period, but no idea what happenned to it, as this was after the separation.

The 'mate' he ripped off in the end decided he couldn't be bothered to persue the money (police weren't interested for £300)!!!

He filed a Police report, but my fiancee's ex retaliated with a campaign of harassment. We asked the guy to make a statement to give to the court, but he doesn't want the harassment.

The guy is an utter creep.
