Selling car with no MOT

Hi guys. The time has come for me to get rid of my old Rover 216 (which I never use now I've got the MR2).

Thing is, when I came to check the documents, it's MOT had expired.

I put it on autotrader dirt cheap, clearly advising potential buyers that it has no MOT. I've already had a guy phone and he's in a real rush to get his hands on it. He wanted to collect tomorrow but I can't make it, so we're arranged for Wednesday night.

The question is, am I liable if he decides to drive it with no MOT?

I've clearly told him both in the advert and on the phone, but I don't know the law well enough to say if that'll discharge any legal duties I have.

Any advice much appreciated.

I'd make sure the bill of sale clearly states all the facts. Get him to sign a copy.

When I sold my XJS which was subject to sorn (ie no tax or mot), the bill of sale put together stated that the car was un-roadworthy and we both signed and dated a copy for each other. After that it wasn't my problem what he did with the car (although in reality, he did use a trailer).

He could of course be driving it directly to a garage to have it MOT'd the next morning.

Make it clear on a receipt in duplicate [one copy kept] and get it signed that it is sold as seen without an MOT and if used in Great Britain the vehicle will not be used until it has been put in a condition in which it might lawfully be used.

This should protect you against the offence of selling a vehicle in an unroadworthy condition (S75 RTA 88) if the new owner was stopped on the way to have an MOT and defects found.
