So are they required to provide the photo at least 7 days before trial or provide it if requested?

Nick Freemans quote is not exactly correct. Disclosure evidence can even be done on the day of the trial if both sides agree to it!

The defence is hardly going to agree on the day of trial if the prosecution is out of time though.

Could it be made a standard where the photo has to be sent out with the nip? Would probably halve the amount of tickets issued (due to poor evidence that they hide on the basis most people will just pay) and then also people could at least build a defense against these cockcroaches?

Does this also apply to other items of evidence and related documents?

For example calibration certificates, manuals etc?

I think this was done initially in France but there were too many occasions of the driver having to explain to their "better half" who the person in the passenger seat was! (Possibly just an urban myth, but a giggle just the same! )

Any evidence of disclosure is subject to the same rules. It could be the knife in a murder trial or the photograph in this instance.

When I had to attend court for a speeding offence a few years back, my Solictor had requested a copy of the video (VASCAR) evidence, which the Police seemingly didn't want to send so the court case got moved by a month 3 times, when we finally got the video it was less than 7 days before the trial, does that mean that the trial was, or could have been 'invalid' in some way?

Having just read the article in MCN, it would seem that the 'best' approach might be to go to court without having asked for any photographic evidence, (assuming they did not already send it), plead not guilty and then if/when they produce it claim that it is not admissable?
