Speeding case thrown out due to cop error
Discussion
Daily Post today has the case of a guy allegedly caught doing 87 mph in van. Case was thrown out as the cop did not check the accuracy of the laser gun at the end of his shift.
He claims he checked it at the start of his shift!
Perhaps someone doing 87 mph in van needs to be nicked but that's another issue.

Nah, everyone knows white vans are the fastest vehicles on the road

Perhaps, but many Sprinter / Veedub vans are quicker than your average family hatch flat out. Wouldn't be a good move if it's fully-laden though.
The van belonged to Help the Aged. I trust it was not full of seniors.
Charity stuff maybe.
Good stuff.
The exact same factor was also one of the numerous factors in my case, however this was not deemed enough to throw the case out at Magistrates or at Crown Court...
I guess the CPS brief and camera operator did not know to answer every cross examination question about the standards set in the ACPO Code of Practice by repeating 'They are only guidelines...'. until questioning stops.

OK this is the aftermath of a consultation and not the actual legislation which I'm not sure of the current status and position there.
But you get the picture....

I like this version of the story:

The solicitor told the court that the code of practice also called for officers to note the presence of other vehicles in the vicinity at the time the speed check was being carried out.
"I am not aware of that, and it would be impractical to do that," replied PC Threlfall.

Impractical? Yes, because there are so many cars on the roads! And they could influence the signal by reflection but not be noticed by the operator. So how come the operator was "not aware" of that requirement? How many others are similarly not aware? How many false readings are being used for prosecution simply because people will not fight due to fear of worse consequences? Too right "...all the while road safety is being forgotten", Paul.
