The Court has another method to deal with the cost of past actions. They could rule the practice incompatible with law and require the change from today (or some time in the future) rather than ruling that it was always wrong.

Proportionality point would support the use of 172 to identify a driver. Might not support the prosecution of an individual using that information as a key point of evidence. Hence flash - 172 - OK, it's me - offer 3pts + £60. If you pay then you have no complaint. If you don't, they can prosecute but need another way to prove you were driving.
