Hi all,

My cousin was involved in a car crash 11 months ago. She was the front seat passenger and unfortunatly she was charged with causing the accident (Long story but she was found not guilty this week thank god)
Anyway what i want to know what is going to happen to the driver. This is the list of his previous convictions (that my cousin didn't know about!):
He already 3 points for careless driving, 6 points for driving without insurance hence he had had his license revoked. So for the new offences he was:

Driving whilest his license was revoked,
Driving without an MOT,
Driving without insurance,
Driving with 1 bald and other inflated tyre,

On top of already having 9 points.
Just my curiosity getting the better of me as the accident was horrific and he blamed it all my cousin, so personally i'd like to shoot him.

She was the front seat passenger in a car going down the M1 between j1 and j2 at about 3 in the morning. There were two brothers in the car sitting in the back who weren't strapped in + the driver that wasn't strapped in even. She was leaning through the seats talking to them in the back and when she turned round she thought they were going to hit the central reservation so to avoid a accident she touched the wheel. Unfortunatly 1 of the brothers went out the back window when the car spun and was seriously injured (14 days in a coma). The driver turned round and blamed it all on her. She was charged with 1 count of GBH and 3 of ABH as there were no driving offences she could be charged with.
There were 2 witnesses that said the car had gone past in excess of 100mph etc, etc. And apparently 1 tyre on the rear was bald and at 45psi (On a Golf GTI!?!) and the other rear one was at about 40-45psi, the two at the front exploded on impact with central reservation.
Luckily its all over now and she was found not guilty.

my word that is one hell of an accident, good to hear your cousin was found innocent, the driver seemed a bit of a moo.
shooting him seems fair if he was prepared to let you cousin take ALL the blame

Id like to say, considering how our CPS usually treats drivers...this is a man who will be meeting some special new friends for a protracted stay, who have a particular fascination with the back of his pants. If all that previous is available for sentencing...he might well get porridge....well within the maggies rights for those offences I believe

Alternatively...his solicitor might manage to convince some dodering old bast**d magistrates that he's a lovely boy normally...and he'll just get more points and a fine.

Just spoken to my aunt and uncle, i don't know what sentence he got but it wasn't prison

ARAGH!!!!!!


Just found out from my Mum that 3 years and 4 months after the crash, that one of the brothers (not the one that was seriously injured) has started civil proceedings against my cousin. (3 years and 4 months after the accident).

My cousin can't counter claim as the time limit is up. She just wanted to put the whole thing behind her.


This country really fks me off sometimes!

Surely, since she was found "not guilty" already, and the fault appropriated to the driver then there is no case to answer?

She was found not guilty of 3 counts of GBH, whether or not she caused the accident wasn't discussed in court, hence why they can bring civil proceddings.

Eh?

Have a quick word with CAB/Solicitor as there may be some grounds to extend the time limit on taking civil proceedings if counter claim to be made. On what already said it seems it is going to be a long hill to climb.

Punishment for driver. In the hands of the Bench. 6 months pokey for drive disqualified or another extended ban again and fine, lap of the Gods.
