So you saw the entire accident from start to finish, and somehow you were able to determine that it was 100% caused by the fact he was on his phone?by a Van driver on his phone...with dire consequences.

No Evidence He Used His Mobile
A TORY MSP yesterday escaped prosecution for using his mobile phone while driving after he argued there was no evidence he was using it.
Ted Brocklebank, an ex-lover of former newsreader Selina Scott, was spotted by police holding the steering wheel of his Range Rover in one hand and his mobile phone in the other.
PC Claire Galloway yesterday told a court: "The driver had his right hand on the steering wheel and his left was holding a mobile phone.
"We could clearly see him looking down at his phone."
Her colleague, PC Andrew Walls, also gave evidence that he saw Brocklebank holding a mobile in his left hand, with "his head tilted to the left".
The officers pulled Brockle-bank over and charged him.
But at Cupar District Court, his solicitor argued there was no evidence the device had been used to "send or receive communications".
James Laverty said: "The Crown has failed to show the item was in working order and without that, we are left in the situation that this offence has not been proved."
The MSP, who represents mid-Scotland and Fife, was stopped on the A919 at Guard bridge, near St Andrews, on May 7, last year.
Justice of the Peace Harry Terrell said: "We are in uncharted waters legally. I have no option but to fall back on my own experience of the word 'using'.
"There was no evidence presented of the word 'using' being used in the normal sense of the word and, therefore, I conclude there is no case to answer."
Brocklebank refused to comment as he left court.
But Neil Greig, of the IAM Motoring Trust, said: "The fact this is an MSP, who has been cleared on a technicality, has set a very bad example."

If the phone was in the door pocket and not touched she has done nothing wrong.
Tangentally I'm amazed at the number of cabs I get into that don't have car kits. Here is someone who spends all of his working day in a car and still won't shell out the amount he spends on two tankfulls of fuel for a top of the line car kit. It's not just about being legal and/or safe, it's a real pain using a handheldand driving.
