I've done a search with reference to the topic and read allsorts of stories about parking tickets but i'm still not convinced to chuck it in the bin!
This is the company who issued the charge http://www.cp-plus.co.uk/

What i would like advice on is....where do i stand "legally" and should i pay the £80 (or £50 if paid within 14 days)

It all very well saying bin it.....but on what grounds?

Like i said.....where do i stand legally? The vehicle was parked in the said place!

The point is that neither you nor they know who parked it there. However when we get these things we should also bear in mind that the parking companies have been employed where uncontrolled parking can be a problem for some businesses so we have to be carefull where we park.

Legally, to get a penny out of you they will have to invest hours of their time and £30 of their own money taking a person to court they don't actually know is alive, financially solvent or even exists as the DVLA database is 20% out.

Thats a leap of faith when there are plenty of chumps who put a cheque in the post, or at least write back to very kindly inform the company that not only are they alive and well, they actually give a sh**.

So i should really be paying this in the eyes of the law?
What your saying though is.......ignore it and they wont bother chasing it up?

Also, is the registered keeper responsible for the vehicles parking notices?

My son got the notice, whilst driving my wifes car!

They have a photo of a car and a number plate.

That car might be registered to a fake person or the details might just be incorrect.

In any case, just because they have a photo of a car which may be registered in your name, they still have to prove to a court that YOU have formally entered into a contract with them by viewing signage in the form of a binding contract and freely entered into it.

If you just ignore everything, they are not going to waste £30 on legal action where no-one is going to turn up as they are taking action against a fake person, or the accused rolls up and denies everything, leaving them with no evidence to support a contract.

Don't pay.

And suggest you read further -Streaky has posted a reply ,which explains the position clearly --

Namely the contract in civil law is between the driver and the parking company and the driver .If they contact the Registered Keeper ,there is no legal onus on the RK to disclose the ID of the driver .Indeed ,as per Streaky's letter the RK can threaten to take legal action on the parking company for harassment .I'm waiting for something to end up on my windscreen as often I don't put a ticket on the dash whilst shopping in Sansbury -something like "this could be a legal demand for damage to my car -my wipers don't work after your operative put a notice under them ",or a fee for removing glue off notice to any window . Somehow I don't think I'll get one ,as I took a notice into the store manager to complain about a notice under my wipers -"you have parked in a mum & kids space -we don't see a child seat in your car " - so I took my 11 year old grandaughter in ,asked to see manager andcomplained LOUDLY .I also sent in an e mail complaint .We've had the parking lady come up to us to find we have had grandson in tow -so now they are wary of saying anything .
They might bluff and bluster , but their threats are like a dog with a bad stomach - so much bad air and liquid .

Or you can go and spend a penny and then wipe your a**e with the ticket - I don't know what the legal position about sending it to them afterwards would be though....lol.

How old do the kids have to be before they do not qualify for parent and child parking?

If the ticket is headed:

PENALTY CHARGE NOTICE..... then it is one which should not be ignored.

if

PARKING CHARGE NOTICE.....is has no statutory authority - civil contract - deal with it as mentioned above.

I have had two parking tickets from Euro Car Parks. Have chucked both of them in the bin and neaver heard a thing (1 in 2006 and one in Summer this year).

If they are issued by the council cough up, if they are private some don't chase you beacuse they have to pay the DVLA for you info to chase it. They just hope you will pay it.

On a side note, if you get a ticket from the council and it is the first ticket you have got from the council issuing it, then write a letter straight away to contest it, come up with the best excuse you can. They quite often let you off the first one. And if they say no, what have you really lost?!

Yeah I can testify to the truth of that!
First one I challenged (on behalf of my eldest) was waived...the second went all the way to the LG Ombudsman who kicked it out as being an out of time complaint...still the lad hasn't paid up though....Waiting for the summons and are they gonna get shafted if they ever issue it... Mwah ha ha ha!evil

If they do issue proceedings and go for a small claims court claim, do you then have to take a day off to go to court and defend the £30 claim (which may cost you considerably more).

Doesn't the "it's not worth it" analysis work both ways?
