So with the car having been off the road since early Feb and TVR having had the engine for the last couple of weeks, I'm a little (!) perturbed to be told that the warrantry company are claiming wear and tear and refusing to cough up. The car is a 2001 S with 14,000 miles – I know we aren’t driving Toyotas but wear and tear in 14,000 miles requiring a complete rebuild?

I bought the car last May and bought the best policy available for 2 years - It now transpires that the warrantry company changed their policy in September to include wear and tear....

Has anyone been in a similar situation? What can be done to get a satisfactory (cheap) resolution?

Who is the policy with? My Tuscan has had two rebuilds and Auto protect covered them both, the last being 6 months ago!!

How can it be a wear and tear warranty refusal if you don't have a wear and tear warranty?

No, they are refusing a warranty claim because they say its a wear and tear issue, and the wear and tear warranty was not available to me when I bought the car. My issue being 14,000 miles ain't a lot of miles for an engine to fail on if there isn't something more fundamentally wrong. Been a fair amount of buck passing but the dealer (as ever) is being excellent so I do hopefully have a compromise resoultion available just interested to know what others have done in this situation.

Warranty is with Autoprotect.

If a percentage - how much 10%, 25% etc?

The policy covered all the work upto the £5000 limit and it was with auto protect. Maybe they have had too many speed 6 claims and they have wised up!!! seems strange that they have changed their policy terms and conditions. A bit of a worry I must say. I will call TVR Barnet to get their views and let you know!!!

Andrew,

I'd check and see if you have the new wear and tear warranty, setup from last September. I assume if you bought the car in Feb you do. I'm pissed off that I wasn't told that there was a new warranty available as I'd have definately upgraded, you don't want to be left in Limbo between the dealer, Autoprotect and TVR.

Even if it is the 'rong' warranty.

I don't see how a 14000 miles car can be refused on wear and tear, it is at MUCH to low a mileage to be refused, without at least a major contribution from the warranty company. 60k miles maybe...

Ask them to specify how wear and tear has been established, vs life expectancy of the engine.

Well with my devils advocat hat on it seems speed 6 engines do give up at around this mileage as was kind of proved on the PH poll

If you bought a warranty with wear and tear clause in it, then it stands until renewal. You say you bought a two year warranty and I assume paid the premium at that time?

A change of cover mid term would therefore appear to be out of order. You should check the small print to determine this. If it is not specified then I would suggest you refer them to the Regulator. Warn them you are going to do this and give them a chance to see sense.

I suspect Autoprotect have found SP6 warranty claims excessive and are capping them.

I managed to get a wear and tear excuse overturned, on my Tuscan
A few letters helped my cause, and asking how the engineer who inspected your engine measured the wear, and what equipment he used.

Wiggling suff with your fingers does not count!!

Just to clear up the confsion, is the following correct? When you bought your warranty it did not cover wear and tear. Subsequently the warranty company has changed their terms and conditions for new warranties and they do now cover wear and tear.

Yes - the warranty company launched a new policy after I had bought mine covering wear and tear. The issue is not that they are shortchanging me on the policy I purchased, rather that I would have appreciated the oppourtunity to upgrade precisely because I didn't want what has happened to happen.

Justin - how many miles has yours covered and who was the policy with? I've put the onus onto the dealer to sort something out (as I bought the car only last May) but to be honest I would rather have the warranty company and/or TVR carry the can.

I have an Autoprotect Premier Plus policy up to the purchase price of the vehicle (over £30k) from May 05 to May 06. I'd be prepared to pay more to include wear and tear.

Don't have the policy to hand but I bought the best Autoprotect policy available in May 05 so I suspect its the same as yours. They added the new wear and tear policy (which by all accounts is extremely comprehensive) last September.

According to the Autoprotect web site, under the MBI (mechanical breakdown insurance) terms and conditions section 4;

4.No liability will be accepted for: fair wear and tear; normal deterioration; the effects of poor
repairs, faults or defects at the time of the sale; parts which have been fitted incorrectly; parts which are of faulty manufacture or design;
or parts not fitted as standard or optional
extra by the manufacturer, unless cover
for such items is agreed beforehand.

So who says they now cover wear and tear?

The Autoprotect representative - Nick Mason. My understanding is that they launched the new policy in September but I do not hold such a policy so I cannot comment on its terms.
