So says a thread on bikeradar, wiggle have responded to an email query from a guy whose order was cancelled and they are honoring the price when there is more in stock.... apparently....

I guess people are questionning why a back order was created for the original order if they werent intending to honour it? surely they would just cancel the order and that would be the end of it?

Still not had an email of any description. Just my account on wiggle has said its cancelled. Have written to them expressing disappointment and requesting an explanation.

We shall see.

So after emails from wiggle saying thet they had run out of stock, followed by ones saying that none had been dispatched at the advertised price I have this final one:-

Thought as much.

I have raised the issue with Wiggle suggesting that there was contract at £163 as I had paid - and that even as a gesture of good will maybe they could honour this.

Have been told, very politely, to foxtrot oscar

I'm trying the Evans Price Match to see if they'll do them at the £263 price. Still want a pair but don't fancy giving my hard earned to Wiggle for them.

£217 for Campag freehub at Ribble using the current 13% off code, they don't list Shimano though.

I ordered very early on Wednesday and I have spent a lot of cash at Wiggle lately as I'm currently on a build with Campag Super Record

Don't know if either of those were a factor...

You cant really blame Wiggle, seems like a mistake , I bet about 100 or so people ordered them, so to full fill them all would hit them hard, when their margins are very very tight anyway.
I bet their T&Cs which you have to agree to cover this issue

There was very much a contract - and in there will be something along the lines of "errors and ommissions excepted" which this will fall under. They're trying to be nice about it at the moment; "sorry" etc, but in reality they could just say the T&Cs mean we can do this.

It's quite common in internet land; so often currys would put a tv up with a decimal in the wrong place, or something equally so. The alert to them is often hundreds of people buying very quickly.

It's an often misquoted part of business law, but even if a shop advertises something for a price, and you want to buy it at that price, they don't have to sell it to you. They can up the price at any time (due to demand, due to the fact that they just don't like your face, whatever).

The contract doesn't start until you've paid your money for those goods and wiggle has accepted it. In this case, due to the automated nature of their systems, a few probably went through to the warehouse and were shipped before anyone noticed the error. As soon as they did notice it, they can just claim they have no more in stock and issue you a refund. That's when the contract ends.

They are under no obligation to honour that price in any future listings. Though they may choose to for PR or for valued customers.

Well my understanding is that even though I had given payment details, the fact that they have the ability to refund the payment means that a contract wasn't completed.

I am not sure precisely when it does complete. But the above is from Pinsent Masons, so I am inclined to believe it.

Possibly sets a poor precedent if cup of beans has had his honoured

While it may well be that it wasn’t a mistake, chances are it was. And while I’m sure Wiggle can soak this up it’s such a strange part of the British psyche that people start looking for precedents when they’ve been denied the chance to fvck over an internet seller.

FWIW, I’m the same. If I get too much change in a shop I’ll normally let them know but if they leave a bottle off the bill at a restaurant I’ll have my coat on and be out of the door before the card machine has finished printing the receipt.
