I am desperate for a job, and went for an interview this morning, but something they said is making me feel uneasy about the job.
The contract states that if you wear underwear it can't be certain brands that the company sells, they say that you have to agree to random underwear checks, this means that random members of staff have to show security the tag on there underwear to prove it is a different make to those stored in the warehouse.
Can they legally do this?

No? I wouldn't worry about it then
A very famous clothes brand has had many a theft by employee who get a trainee to pick up stock so it can be spot checked, they then remove tags, etc, go to toilets during lunch and then put the clothing on and if queried they were wearing it to work... when trainee asks where the clothes are, the employee tells the trainee that they have already replaced them, so certain people have now been banned from wearing brand clothes.
Another one did something similar but would actually use the internal posting system to post the clothing to her mothers address, by the time she was spotted a cool $250-300k of clothing had gone... luckily for the person involved they did not press charges (reputation of company at stake) and she was black listed from working for another clothing brand.

I think you're worrying about nothing.
Do you really believe they'd have any workforce left if they made you get up on a table and drop your trousers every night before you left?

They're probably afraid you're going nick their products by wearing them under your trousers when you leave the premises. You would be pretty stupid to try it without removing the RFID tag so I'm not sure what they think they are going to achieve except a good perve. 'Legit' underwear would have already have had the tag removed at the point of sale.
As for your rights, retain Cherie Booth (aka Mrs Blair) as your QC.

Wear your sttiest, smelliest, dirtiest undies, I can pretty much guarantee they will only check you the once
