Hi looking for some advice about what has just happened to me. I fractured my ankle last week at work. Happened first thing in the morning as I was getting out of my van. Was rather sore but continued working and finished the job and completed another one as I was the guy on call.

My girlfriend took me to hospital to be told yeah its fractured and they said I was stupid for driving with it like that. Anyway they give me a sick line for 4 weeks. I hand it in and when doing so the boss is asking why I can't come in and work in the depot. I said the Dr has marked that I am unfit for work. He tells me that they are disappointed and they expect more from their staff even when something like this happens. A few hours later I get the call from him and that they are serving me with 4 weeks notice after that I will be terminated with the company.

Are they able to do this ?

Sorry to hear what's happened to you.

It does sound bizarrely harsh if there's nothing else behind it.

Has anything else gone which might mean they've just been looking for an excuse to get rid of you?

Have you had much other sick leave or anything like that?

As said above it doesn't sound like there's a lot you can do given the time you've been there, unfortunately.

I would call them to say you had no intention of making an employer's liability claim against them initially as you expected them to be supportive, but as they aren't being, you'd like the policy number and name of their EL insurers.

That should put the wind up them. See if perhaps they then might negotiate with you.

I'd be tempted with the above, too, despite being anti-ambulance chaser generally.

TBH I woulda gone in and seen what work I could have done. (Have had a plaster round my ankle for 6 weeks in the past but it was an office-based job.)

It is now 1 year for employment protection iirc.

so OP you may have a case for them to answer. have a chat with citizens advise.

That said, on the insurance point, if I were your employer I would be looking carefully at the insurance policy about letting you work whilst signed off - it might well be vitiated by that - before I suggested that perhaps you should come and help with the admin for a few weeks!

I would also suggest that you need to look into if your car insurance is still valid (no idea as not had to check mine on this point) even if you can drive IYSWIM.

i broke my leg years ago, and the doctor signed me off, i did ask if i could go in as i was office based, but as soon as the doctor realised i would be commuting on trains into london he wouldn't let me as it was touch and go if i needed an operation to pin it.

5 weeks came and went and i just went back in, just to be sent home an hour later to see the doctor to get the all clear as the insurance wouldn't cover me until i got medical clearance. i had to wait 3 days to see the bloody gp to get signed back on.

daytime tv was truly awful in the early 90's smile

It's 2yrs now. It was 1yr.

We have had words over my commitment to the company lately nothing formal but I would say they have been wanting to get rid of me so this has happened at the right time for them. They said would i be able to cover the depot whilst I'm injured. They said just to cover the phones but tbh it wouldn't be just that. I would have to make hoses up if a customer came in. And I was going by my sick line as the doc ticked the unable to work box not the could work with modified duties section.

Claim for your injury off their insurance.

If they legally fk you over you legally fk them over.

Sounds like there is more to it than that, but if not then that sounds unbelievably harsh but such is the way of the world. I would certainly be an awkward bd and do anything you can to money grab (only if they're not willing to keep you on) and I'm certainly no "ambulance chaser" as you guys put it. If they want to be nobheads then be a nobhead back but just make sure you're 100% not staying first.
