Thirteen weeks with an agency

I'm currently working for an agency and signed a contract to say that I would work for them for thirteen weeks and then transfer over to the company's books. There are several of us from the same agency and our start dates were staggered so that none of us reach thirteen weeks at the same time. One lad passed his a month ago, another two weeks, while mine is next week. Those two people have not been taken over by the company but are still working there, still under the agency. When asking about it they've simply been told "we don't know what's happening".

Our contracts say temp to perm after thirteen weeks, at which point we will transfer to the company we work at. Is there anything we can do considering this has not happened? Neither of the guys know if they're keeping their jobs. Is this something ACAS could help with?

An agency can't form a contract between yourself and an employer on the employers behalf.

One of the few things you can do is assert your rights under the agency workers regulations some of which kick in after 12 weeks.
