i have got a new job, i have been in my current job 9 months. 2 weeks prior to handing in notice, my probation period was completion, which means my notice period changes to 2 months from 1 month.

i told my new job 1 month which was right at the time, which i told the company i work for i would give. The problem, besides pissing my current company off, is i am owed 3 weeks wages worth in holiday.

do they have to pay it or is it lost?

If you've accrued the leave but haven't taken it, and they don't allow you to use it during the notice period, then it should be paid to you in your final pay.

even if notice is 2 months and i give a month.

I don't believe they can deduct anything from wages without you agreeing, however, If you owe then 4 weeks notice and they don't pay you for 3 weeks holiday. What are you going to do. You could sue for breach of contract(not being paid what is owed) Your employer could do the same as you haven't fulfilled your notice requirements.

the crux is my contract is for a set work pattern and for 5 months i have worked another pattern due to long term sick, i wouldn't have taken the job if i had known.

Give the 2 months notice and take the last three weeks as holiday.

cheers in end working 4.5 weeks and paying holiday so all good.
