Notice periods & lack of work (contracting)

Just trying to get my head around something as I'm hunting for a new contract. At my last place, I had a day and a half unpaid because they were unorganised and I foolishly said I had nothing to do (from which I've learnt to always be "busy"). However, what happens if the client says there is there no work available, whilst serving a termination notice at the same time? Theoretically, is it a court matter for breach of contract, or being more realistic is it likely you don't fight it and just search for a new contract?
I'm essentially wondering if it's even worth having a notice period in a contract if it amounts to little?
