So need some help and advice please.

Today another person at works says can I apply for your job then. I wonder why they are talking about and they says its advertised on Linkedin. Me confused face.

I check and yes there is is my exact job description and title. Go direct to my boss who is also the HR manager, to ask him what its all about. He says don't know nothing to worry about, he'll talk to the plant director (his offsite) about it and get back to me.

I check the internal company website, my job is on there. After an hour I finally sit down with him.

He says some crap about them getting someone in above me as my current boss does not have time to support the role (true his useless).

But I think that the hour its taken to get a response is him and the boss coming up with some excuse for the advert and it shouldn't have been posted yet.

I've been thinking about leaving since having to report to this new boss. This is the nail in the coffin for me.

I will be raised a grievance.

But would I have any grounds for constructive dismissal? Would anyone be able to point me in direction of anyone I could talk to about this????

Let them try and replace you. If you haven't had any reviews or any disciplinary they cannot just fire you. You also cannot be made redundant as your job clearly exists. The HR manager sounds utterly incompetent. You could be in for a nice (but stressful) pay cheque if you have given us all the facts. (Make sure you have some money put aside to lodge a claim and get in touch with a decent HR company. I know a very good one that saved me thousands based in East Mids.

No disciplinary no issues raised when having reviews.

So as you say let them try.

Could you send me the details of that company please

A lot of assumptions here. The bare facts are you are still doing the same role for the same pay and the same terms and conditions. Who you report to is to some extent irrelevant. Whether they hire another person using the same job description or advert to be alongside you, above you or below you is not illegal.

edc never said it was illegal and what you say is true.

But i work for a huge corporation whos structures and reporting lines are very clear. This supposed new role does ot exist in that structure. An hour to tell me what is happening seems odd don't you think.

If they are saying that it is a role above yours then you should apply and show your interset in supporting the company and your own persoanl development. This may not be actually what you want but could get interesting.
